Dear Tara Inverso:
Laser Isotope Separation Technologies, Inc. (LIST) requests a Nuclear Regulatory Commission (NRC) non-possessing Facility Security Clearance (FCL) so that its staff can apply for NRC personnel security clearances (PCL) needed to access classified information. Prior to the Department of Energy (DOE} designating UST technology as classified Restricted Data (RD),
LIST will have constructed a "closed area" to use and store its laser technology. Also, it is LIST's intent to have its "closed area" inspected and approved by the NRC before DOE declares its technology as classified RD.
Enclosed is a non-possessing Standard Practice Procedures Plan for review as part of the FCL request. Additionally, NRC Form 405F, "Owners, Officers, Directors and Executive Personnel,"
Standard Form 328, "Certificate Pertaining to Foreign Interests," LIST's Articles of Incorporation, LIST's Bylaws, LIST's Business License, and Foreign Ownership, Control or Influence supporting documents have been entered into DOE's e-FOCI system to support NRC's FCL review.
The address for LIST is as follows: 203 Victorius Blvd East Oak Ridge, Tennessee 37830 In accordance with Title 10 of the Code of Federal Regulations 95.17(b), LIST also requests that the NRC grant an interim non-possessing FCL at the SRO level. This interim clearance will enable UST to submit applications for Q PCLs in advance, while the final FCL request is under review.
