1980, Ro'chester Gas and Electric Corporation (RGLE) submitted additional information related to RGKE's December 20, 1979 application for R. E. Ginna Cycle 10.

This application pertains to use of mixed oxide fuel assemblies.

Attach-ment B to RGEE's February 20, 1980 filing has been deemed to be proprietary by Westinghouse Electric Corporation (WEC).

RGRE, there-fore, requested that this information be withheld from public disclosure pursuant to 10 CFR Section 2.790 of the Commission's regulations.

WEC's letter dated February 5, 1980 (WS-RAW-005),

R. Wiesemann to D. Ziemann, incorporated by reference the affidavit pertaining to application for withholding AW-76-31 dated, July 27, 1976.

(AW-78-27, dated March 22,

1978, NS-CE-1731, which transmitted proprietary report HCAP-9272, "Westinghouse Reload Safety Evaluation Methodology,"

is also referenced.)

Your reason for requesting withholding of this information included the fact that the information has consistently been held in confidence by WEC and that the information reveals the distinguishing aspects of a process which is a product of HEC design technology.

You state that

Nr. R. A. Wiesemann September 29, 1982 the essence of the competitive advantage in this field lies in an understanding of which analyses should be performed and in the methods and models used to perform these analyses.

You maintain that release of this information could reduce the expeditures of your competitors and, thus, obviate the competitive advantage now realized by WEC.

You also state to the best of your knowledge, the information is not available in public sources.

We have reviewed your application and material based on the requirements and criteria of 10 CFR 2.790 and have determined that Attachment B to RGKE's letter dated February 20, 1980 contains proprietary commercial information.

We also have found at this time that the right of the public to be fully apprised as to the. bases for and effects of the action does not outweigh the demonstrated concern for protection of your competitive position.

Accordingly, we-have determined that the information should be withheld from public disclosure.

We, therefore, approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding Attachment B to RGEE's letter dated February 20, 1980 from public inspection as proprietary.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you or RGKE should promptly notify the NRC.
