This refers to the inspection
conducted
by Mr. J.
Kramer and other inspectors
of this office on January
28 through
March 9,
1996, at the Palo Verde Nuclear
Generating
Station,
Units 1,
2,
and 3, facility.
The purpose of the
inspection
was to determine
whether activities authorized
by the license
were
conducted
safely
and in accordance
with NRC requirements.
At the conclusion
of the inspection,
the findings were discussed
with those
members of your
staff identified in the enclosed
report.
Areas
examined during the inspection
are identified in the report.
Within
these
areas,
the inspection consisted
of selective
examinations of procedures
and representative
records,
interviews with personnel,
and observation of
activities in progress.
The results of this inspection
are documented
on
page
1, in the enclosed
report.
Section
9,3 of the enclosed
report identifies
a noncited violation of
10 CFR 50, Appendix B, Criterion III, "Design Control," for failure to
identify and test
backup containment
protection devices.
This
violation, which normally would have
met the criteria for a Severity
Level
IV
violation, is not being cited in accordance
with Section VII.B.3 of the
NRC
Enforcement
Manual.
The violation was not cited because it involved old
design
issues,
was identified by a voluntary licensee initiative, was
. adequately
corrected,
and
was considered
unlikely that routine licensee
activities would have identified the problem.
We commend your initiative to
- reexamine your design
and encourage
your continued voluntary review of old
design
documents.
In accordance
with 10 CFR 2.790 of the
NRC's "Rules of Practice,"
a copy of
this letter
and its enclosures will be placed in the
NRC Public Document
Room.
