Dear Mr. Backus:

This is to confirm my telephone call to you of December 29, 1978. You stated that you were not prepared to furnish a statement of the issues you wish to pursue at the evidentiary hearing beyond your previously stated intention to challenge the Staff's comparison of Seabrook with the following four alternate sites:

Litchfield, Phillips Cove, Pilgrim and Millstone.

In response to your failure to comply with the request of the Appeal Board in its Order of December 26, 1978, I informed you that the Staff would present the following four witnesses at the hearing:

1.

J. Kline - Team Leader 2.

G. Gears - Terrestrial Resources 3.

C. Hickey - Aquatic Biology 4.

M. Kaltman - Socioeconomics and Visual Esthetics You indicated that you cocid think of no additional Staff witnesses who would be needed at the hearing. Accordingly, it is my unde.' standing that the issues you plan to pursue at the hearing will be within the scope of the testimony prepared by the four witnesses listed above.

(Their specific sections of the testimony are identified in Table 1, on page I-4 of the Staff's testimony).

If this understanding is incorrect, it is imperative that you inform me promptly of any additional Staff witnesses whose presence woula be needed at the hearing.
