FACILITY: Power Authority State of New York Fitzpatrick Nuclear Power Station Docket No. 50-333 Oswego, New York

SUBJECT:

SUSPENSION OF FITZPATRICK, NPS BURIAL PERMIT BY SOUTH CAROLINA Region II was advised by their onsite inspector at Barnwell, SC, that South Carolina officials had measured a 300 mrem /hr surface reading on a plywood box on an open bed truck on July 28, 1980. The measurement was taken upon arrival of the truck from Fitzpatrick NPS, Oswego, NY.

t South Carolina has suspended the burial permit for Fitzpatrick, NPS, and is con-sidering imposing a $1,000 civil penalty under their recently enacted legislation permitting highet enforcement actions for violation of SC DOT rules.

~ Region II has discussed this matter with Region I and the State of South Carolina.

Region I has informed the State of New York and the licensee. DOT has been noti-fled.

Media interest may develop because of continuing interest in transportation of radioactive materials and South Carolina's possible imposition of a civil penalty under new legislation. The State of South Carolina stated that they do not plan to issue a public statement. The Power Authority of the State of New York (PASNY) has just been informed and is considering the matter. If PASNY does not issue a press release, NRC Region I plans to do so.

Region II (Atlanta) received notification of this occurrence by R.lgaone from a J

Region II inspector at 4:50 p.m. on July 28.
