APPENDIX A NOTICE OF VIOLATION i

i J. M. Corboy, M.D., Inc. N c Licence L. 33-18343-01 302 California Avenue Suite 204 Wahiawa, Hawaii 96786 As a result of the inspection conducted on May 13, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified.

A.

License Condition 16 requires that, except as provihd C,ervise by this license, the licensee shall possess and use licensed material described in items 6, 7, and 8 of this license in accordance with statements, represen-tations, and procedures contained in the application dated November 9, 1978, and letter dated December 19, 1978, signed by J. M. Cori.

v, M.D. The December 19, 1978 letter states that licensed materials w dl be contained in a shielded and locked box supplied by the manufacturer, and will be locked in a triple rated (fire-water-shock resistant) safe.

Contrary to the above requirement, the New England Nuclear Model NB-1 eye applicator, was found in an unlocked condition sitting on the floor of the minor surgery room.

This is a Severity Level V Violation.(Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, J. M. Corboy, M.D.,Inc. is hereby required to submit to this office within thirty days of the date of this notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompliance; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
