NPS Industries, Inc.

Docket No. 99900763/81-01 APPENDIX A NOTICE OF VIOLATION Based on the results of an NRC inspection conducted on November 17-18, 1981, and in accordance with the Interim Enforcement Policy 45 FR 66754 (October 7,1980), it appears that certain of your activities were not conducted in full compliance with NRC requirements as indicated below:

A.

Paragraph 21.6 of 10 CFR Part 21 states in part, "Each individual partnership, corporation or other entity subject to the regulations in this part, shall post current copies of the following documents in a conspicuous position on any premises within the United States where the activities subject to this part are conducted:

(1) the regulations in this part...."

Contrary to the above, the copy of the 10 CFR Part 21 regulations that was posted in the NPS Industries, Inc., Secaucus, New Jersey facilities was dated June 6, 1977, whereas the current issue of the regulation is dated July 24, 1981.

This is a Severity Level VI Violation (Supplement II.F).

B.

Paragraph 21.31 of 10 CFR Part 21 states,"Each individual, corporation, partnership or other entity subject to the regulations in this part shall assure that each procurement document for a facility, or a basic component issued by him, her or it on or after January 6,1978 specifies, when applicable, that the provisions of 10 CFR Part 21 apply."

Contrary to the above, procurement documents for basic components issued from January 6,1978 to August 8,1980, did not specify that the provisions of 10 CFR Part 21 apply even though the regulations were applicable to the procurements.

This is a Severity Level V Violation (Supplement II.E).
