Licensee Action on Previous Inspection Findings (Closed) Noncompliance (77-01-01).

Contrary to 10 CFR 70.53, Material Status Report (Form NRC-742) for the period January 1, 1976 - June 30, 1976, was not submitted within 30 days after June 30, 1976.

The inspector determined that all Material Status Reports submitted by the licensee after June 30, 1976 were issued within the allotted time period of 30 days.

30703 - Exit Interview The inspector met with the licensee representative (denoted in paragraph

1) at the conclusion of the inspection on February 4, 1982.

The inspector summarized the scope and the findings of the inspection.

85202 - Facility Organization No violations were noted.

The inspector determined that the licensee had issued acceptable written material control and accounting procedures entitled, " General Procedures for Handling Nuclear Fuel Rods and Pellets for Laboratory Examination".

These procedures had been issued by the personnel charged with accountability responsibilities for the period under review.

85204 - Operation No violations weru noted.

The facility is an independent consulting, testing and research labora-tory specializing in ores, concentrates, metals and alloys, and related products.

The firm is associated with NUSAC (formerly Nuclear Surveill-ance and Auditing Corporation).

It was through this organization that they received radioactive materials for test and analysis.

The material was essentially enriched uranium in the form of "0 and under 3% enrichment.

2 As of May 10, 1979, the licensee had discontinued its Special Nuclear Material (SNM) analysis operations. However, the licensee is currently in the process of obtaining a New York State license and plans to continue its analysis operations for source material only.

3 On October 27, 1980, the licensee's authorized possession of SNM, under their license SNM-137, was reduced from 500 grams of U-235 to less than three hundred fifty (350) grams of U-235 by NRC Licensing.

The expiration date was also amended to read, " September 30, 1981".

85212 - Physical Inventory No violations were noted.

The most recent physical inventory conducted by the licensee was on October 29, 1980.

The licensee's reduced scope of activity had not resulted in any balance greater than 500 grams U-235 for the period December 1, 1976, to October 27, 1980, nor greater than 349 grams V-235 for the period October 28, 1980, to February 4, 1982.

The present balance of enriched uranium is 35 grams of U-235 in compressed and sintered pellets.

85216 - Records and Reports No violations were noted.

The inspection covered the period of December 1, 1976 through February 4, 1982.

The records and reports inspected for this period included an audit of all Nuclear Material Transaction Reports (Form NRC-741) covering receipts and shipments. No discrepancies were noted.

Material Status Reports (Form NRC-742) submitted during the material balance periods ending March 31, 1977 - March 31, 1981, were reviewed for proper signature, timely submission, and accuracy of data.

No discrepancies were noted.

Since the licensee's authorized possession limits of SNM were reduced to less than 350 grams of U-235, effective October 27, 1980, the licensee submitted a final Form NRC-742 for the material balance period ending March 31, 1981 and no longer was required to submit the reports in accordance with the requirements of 10 CFR 70.53.

The activity for the period covered by this inspection is shown on Exhibit I of this report.
