ALL AGREEMENT STATES, CONNECTICUT, AND INDIANA FINAL RULE - FEE RECOVERY FOR FISCAL YEAR 2021 (STC-21-041)

Purpose:

To inform the Agreement States that the U.S. Nuclear Regulatory Commission (NRC) has published a final rule to modify Title 10 of the Code of Federal Regulations (10 CFR)

Parts 170 and 171 regarding the licensing, inspection, and annual fees to recover, to the maximum extent practicable, approximately 100 percent of its Fiscal Year (FY) 2021 budget authority, less the budget authority for excluded activities.

Background:

This final rule implements the Nuclear Energy Innovation and Modernization Act (NEIMA), which, starting in FY 2021, requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee recovery requirement. Please see the FY 2021 Final Fee Rule Work Papers (Agencywide Documents Access and Management System accession number ML21119A024) for the detailed financial analysis used to determine the final fees. The final rule was published in the Federal Register on June 16, 2021 (86 FR 32146-32183) and becomes effective August 16, 2021.

Discussion: The NRC is amending the flat application fees it charges to licensees to reflect an increase in the professional hourly rate to $288. Changes in the FY 2021 materials fees can be found in pages 32171-32176 of the Schedule of Materials Fees.
