Title:

Annual Fitness-For-Duty (FFD) Program Performance Reporting of Drug and Alcohol Testing Information under 10 CFR Part 26 - Lessons Learned, Best Practices, and use of NRC Forms 890 and 891.

Office of Nuclear Security and Incident Response that support 10 CFR Part 26, Fitness for Duty Programs (FFD) held a public meeting to discuss the annual FFD program reporting requirements in 10 CFR Part 26, review lessons learned, best practices, and use of NRC Form 890, Single Positive Test Form and NRC Form 891, Annual Reporting Form for Drug and Alcohol Tests. The purpose of this meeting was to help licensees and other entities prepare for the upcoming reporting of drug and alcohol testing information to the NRC for calendar year 2022. Commercial nuclear industry representatives who complete and submit the annual FFD program performance reports to the NRC under 10 CFR 26.417 or 26.717 were encouraged to participate in this meeting.

General Details: The meeting began at 2 p.m. EST. The meeting was attended by 68 individuals, including FFD program personnel from licensee sites, the Nuclear Energy Institute (NEI), members of the public, and the NRC staff. Sixty-six meeting attendees participated via Microsoft TEAMS, and two participated by teleconference. A list of attendees is included as an attachment to this meeting summary. The meeting ended at 3:40 p.m. EST.

Summary of Presentations: The NRC technical staff described the annual FFD program performance reporting requirements in 10 CFR 26.717 and 26.417, provided a live demonstration highlighting key features and advantages of using NRC Forms 890 and 891, discussed NRC reviews of FFD program performance data submissions and use of the data provided, and then discussed 17 lessons learned and best practices for completing and submitting FFD program performance data to the NRC in NRC Forms 890 and 891. At the conclusion of the webinar, the NRC technical staff provided a high-level review of changes made to NRC Forms 890 and 891 as a result of the 10 CFR Part 26 final rule published on November 22, 2022. Licensee and other entities have until November 22, 2023, to implement the 10 CFR Part 26 final rule changes.
