MEMORANDUM TO: Laura A. Dudes, Regional Administrator Region II FROM: John W. Lubinski, Director Office of Nuclear Material Safety and Safeguards

SUBJECT:

DELEGATION OF SIGNATURE AUTHORITY - AUTHORIZING THE OPERATION OF FUEL CYCLE FACILITIES As described in Title 10 of the Code of Federal Regulations (10 CFR) Part 70, Paragraph 23(a)(7), and in accordance with Management Directive (MD) 9.26, Organization and Functions - Office of Nuclear Material Safety and Safeguards, the Director of the Office of Nuclear Material Safety and Safeguards (NMSS) or their designee has the responsibility to issue orders, notices, or letters to licensees, consistent with the areas of responsibility of NMSS, which includes the authority to approve, sign, and issue authorization letters permitting the operation of fuel cycle facilities. I am issuing this memo to document the continued delegation to Region II (RII) Regional Administrator (RA), the authority to approve, sign, and issue authorization letters permitting the operation of fuel cycle facilities licensed under 10 CFR Part 40, Domestic Licensing of Source Material and 10 CFR Part 70, Domestic Licensing of Special Nuclear Material. The RII RA may re-delegate this authority to the Deputy Regional Administrator, appropriate Division Directors and/or Deputy Division Director with the responsibilities for fuel cycle facility inspection oversight for construction, pre-operational, and operations, to approve, sign, and issue authorization letters permitting the operation of fuel cycle facilities.

Limitations This delegation survives the incumbent. This authority may be exercised by a person serving in an Acting capacity with advanced written approval by the RA (reference general guidance provided in MD 9.1, Part IV, Section A.7). This authority may not be re-delegated below Division Director level or Deputy Division Director.

This delegation is effective immediately and will be reflected in the next update of MD 9.29, Organization and Functions, Regional Offices.
