Meeting Purpose
- Preview NRC staffs proposal for limited-scope revisions to the final rule on Enhanced Weapons, Firearms Background Checks, and Security Event Notifications (EWRs) supporting regulatory guidance documents
- New Draft Guides (DG) 5080, DG-5081, and DG-5082
- Discuss potential for exemptions regarding licensees compliance with the EWR provisions
- Compliance date for the EWR is January 8, 2024 2

Key Dates
- Final rule on Enhanced Weapons, Firearms Background Checks, and Security Event Notifications was published in the Federal Register

Background Information
- To support efficient implementation of the final EWR, the NRC staff responded to questions on the final rule and supporting guidance documents at multiple events, including:
- three NRC-led public workshops in May 2023
- two industry-led forums / symposiums in June 2023
- Industry has identified several issues in this guidance and requested the NRC provide clarification to:
- Address potential inconsistencies
- Provide additional examples or clarification 5
Limited-Scope Revisions to Guidance
- NRC staff is proposing to issue limited-scope revisions to three guidance documents for the EWR
- DG-5080 - Proposed Revision 3 to RG 5.62, Physical Security Event Notifications, Reports, and Records
- DG-5081 - Proposed Revision 1 to RG 5.86, Preemption Authority, Enhanced Weapons Authority, and Firearms Background Checks
- DG-5082 - Proposed Revision 1 to RG 5.87, Suspicious Activity Reporting Under 10 CFR Part 73
- The NRC intends to focus on those issues that industry asserts may affect a licensees ability to implement the final rule in a timely and efficient manner 6
Limited-Scope Revisions (cont.)
- The NRC plans to issue the three DGs for public comment via individual Federal Register notices
- The NRC plans to hold a public meeting during the comment period to discuss the proposed revisions
- Comments beyond these limited-scope revisions may be considered by the NRC in developing the final RGs, or may be deferred to the next periodic update to these RGs 7
Proposed Schedule
- The NRC staffs goals for this effort are:
- Publish the three DGs for comment in the Federal Register before November 2023
- A proposed duration of the comment period for the Federal Register notices is currently being evaluated by NRC staff
- Conduct a separate public meeting during the comment period to discuss in detail the specific changes proposed by NRC staff
- Disposition any comments and publish the revised final RGs before April 2024 8
Need for Exemptions
- With the projected schedule for revising these three RGs extending beyond the current compliance (implementation) date of 1/8/2024, the NRC staff recognizes that multiple licensees may seek exemptions from some or all of these regulations under the EWR
- NRC staff understands that licensee exemption requests may be informed by the NRCs projected schedule for issuing the revised RGs and may also consider other licensee-specific circumstances, such as:
- Outage schedules
- Procedure development and personnel training durations 9

- NRC staff is available to discuss industrys development of an exemption template approach -
similar to previous multiple-licensee exigent exemption efforts - to support efficient consideration of potential exemption requests 10
