U.S. NUCLEAR REGULATORY COMMISSION REVIEW OF EXPORT LICENSE APPLICATION XB1359

Dear Mr. Madson:

I am writing to update you on the status of your export license application (XB1359). The application is currently under review by the U.S. Nuclear Regulatory Commission (NRC), for the export of cesium-137 sealed sources to the Government of Iraq. Title 10 of the Code of Federal Regulations (10 CFR) 110.40(d), states if the Commission has not completed action on a license application within 60 days after receipt of the Executive Branch (EB) judgement, the NRC is required to inform the applicant in writing of the reason for the delay.

The NRC received the final EB judgment on September 23, 2022. In accordance with NRC policy, this application is categorized as a Commission level case which requires multiple levels of intra-agency review. As such additional time is needed for NRC staff and management to complete its review before the license can be issued.
