SUMMARY

OF SEPTEMBER 21, 2022, MEETING WITH THE NUCLEAR ENERGY INSTITUTE, ON PROPOSED QUALITY ASSURANCE PLAN TEMPLATE (EPID L-2022-TOP-0050)

On September 21, 2022, a virtual observation public meeting was held between the U.S.

Nuclear Regulatory Commission (NRC) and representatives of the Nuclear Energy Institute (NEI) and the Tennessee Valley Authority (TVA). The purpose of the meeting was to discuss the proposed submittal of a template in support of the conversion of a facilities quality assurance program (QAP) from American National Standards Institute Standard N45.2 "Quality Assurance Program Requirements for Nuclear Facilities" to Nuclear Quality Assurance Code NQA-1-2015, "Quality Assurance Requirements for Nuclear Facility Applications." The meeting notice and agenda, dated August 26, 2022, are available in the Agencywide Document Access and Management System (ADAMS) at Accession No. ML22255A151. A list of attendees is provided as Enclosure 1, and the licensees slides are available under Accession No. ML22250A712.

The TVA representative discussed the intent of the proposed template (NEI 22-03), which was to outline the information that should be submitted in support of a conversions from a QAPD initially licensed under ANS 45.2 to the 2015 revision of NQA-1(NQA-1-2015). It was proposed that NEI 22-03 would be similar in structure as an earlier template and would be based on the NQA-1-2015. The TVA representative discussed how the template had evolved to align with the NRC endorsement of NQA-1-2015 and was reviewed for consistency with staff review guidance contained in Section 17.5, Quality Assurance Program DescriptionDesign Certification, Early Site Permit and New License Applicants, of the NUREG-0800, Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants: LWR Edition. It was noted that subsequent approvals, revised commitments, exceptions, and clarifications found in various NRC regulatory guidance were also incorporated.

The NRC staff questioned whether insights from earlier template reviews such NEI 06-14, NEI Technical Report 06-14, Template for an Industry Quality Program Description, Revision 9 (ML102370305) would be incorporated. The NEI/TVA representatives indicated that this template would reflect more of the NEI 11-04 licensing activity, with updates to reflect the recent 2015 endorsement than the earlier NEI 06-14 effort. The NRC staff recommended that any proposed submittal be sure to address the applicability to design certifications. The NRC staff also questioned whether a fee waiver would be sought. NEI/TVA indicated that no fee waiver was intended to be submitted at that time.

Members of the public were in attendance. One comment was provided regarding the availability of the NEI/TVA slides. It was noted that the slides were publicly available as part of the meeting notice and in ADAMS. Public Meeting Feedback forms were not received.
