JAN 11 1993 Ster 1Gonics International ATTH: Dede Huffman Vice President of Finance 4020 Clipper Court Fremont, CA 94538 centlement This refers to your September 23, 1992, letter concerning the FY 1993 annual fue assessment for your Quality Assuranco Program for Radioactive Haterial Packagts Approval No. 0524.
Although, as you stated, the shipping containers were removed from the certificate of compliance in April, 1992, QA Approval No. 0524 has not been amended to reduce the scope frcm fabricator / user (Fee category 10D(1)) to user only (Fee Category 10B(2)), nor does HRC have any record of an amendment request on file or under licensing review to remove the fabricator approval.
Accordingly, Approval No. 0524 is currently classified for purpocos of the _
annual fees na fee category 10B(1).
Licenses and approvals are categorized for fee purposes based on the activities authorized, and fees are assessed based on the possession, not use, of the license or approval.
Should you wish to amend Approval No. 0524 for use only, an amendment fee of
$250 is required as specifiud in 10 CFR 170.31, fee category 100. Please note, however, that Footnote 1 of 10 CFR 171.16 of the current regulations states, " Amendments based on applications filed after October 1 of each fiscal year that change the scope of a licensee's program or that cancel a license will not result in any refund or increase in the annual fee for that fiscal year or any portion theruof for the fiscal year filed." Accordingly, under these current regulations, fee Category 10B(1) would be the appropriate category for the assessment of the FY 1993 annual fee for QA Approval No.
0524. However, the Commission has not yet developed the FY 1993 fee rule. As in the past, all licensees will be notified of the FY 1993 fees, including any changes to the current regulations.
