Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending December 3, 2021 NRC Accepts Hermes Non-Power Test Reactor Construction Permit for Review On November 29, 2021, the Nuclear Regulatory Commission (NRC) staff issued a letter (Agencywide Documents Access and Management System Accession No. ML21319A354) accepting for review and docketing the Kairos Power LLC construction permit (CP) application for a 35 MWth non-power test reactor called Hermes to be built in Oak Ridge, Tennessee. Review of the Hermes CP application will be the first time that the NRC staff has evaluated TRISO fuel, molten salt coolant, and other novel design features for a license or permit. The NRC staff estimates that it will complete and issue the Final Safety Evaluation Report and the Final Environmental Impact Statement by September 2023, benefitting from robust pre-application engagement with Kairos on its novel technologies and the contents of the Hermes application.

NRC Staff Meets with Duke Energy on Transformation On December 1, 2021, NRR held a drop-in with representatives from Duke Energys Lighthouse, an innovation group established by the company as a center of excellence for transformative ideas. NRR/EMBARK facilitated the meeting, with support from the NRCs Office of Nuclear Regulatory Research and the Office of the Executive Director for Operations, which included focused discussion on how to sustain change in an inclusive manner, so that staff participates in transformation. In January 2022, Dukes innovation center plans to host a visit by staff to tour their facility and continue to exchange best practices on transformative culture which EMBARK will share with the rest of the agency.

Items of Interest Week Ending December 3, 2021 Guidance for Implementation of 10 CFR 50.59, Changes, Tests and Experiments, at Non-Power Production or Utilization Facilities; Draft Regulatory Guide; Request for Comment; 10 CFR Part 50; [NRC-2021-0194]

On November 23, 2021, the Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 66464) issuing for public comment a draft regulatory guide (DG), DG-2007, Guidance for Implementation of 10 CFR 50.59, Changes, Tests and Experiments, at Non-power Production or Utilization Facilities. This DG describes an approach that is acceptable to the NRC staff to meet the regulatory requirements Changes, tests and experiments, at a nonpower production and utilization facility, as defined in the DG. Comments are requested by December 23, 2021.

List of Approved Spent Fuel Storage Casks: Holtec International HI-STAR 100 Cask System, Certificate of Compliance No. 1008, Renewal of Initial Certificate and Amendment Nos. 1, 2, and 3; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2021-0135; RIN 3150-AK68]

On November 24, 2021, the NRC published a notice in the Federal Register (86 FR 66926) confirming the effective date of December 15, 2021, for the direct final rule that was published in the Federal Register (86 FR 54341) on October 1, 2021. This direct final rule amended the Holtec International HI-STAR 100 Cask System listing in the List of approved spent fuel storage casks to renew, for an additional 40 years, the initial certificate and Amendment Nos. 1, 2, and 3 of Certificate of Compliance No. 1008. The effective date of December 15, 2021, for the direct final rule published October 1, 2021, is confirmed.

NMSS Staff Accepted Application for Amendment to Holtec Certificate of Compliance On November 24, 2021, staff accepted the application for review of Certificate of Compliance (CoC) No. 1032 for Holtecs HI-STORM Flood/Wind Multipurpose Canister Storage System Amendment No. 7 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML21322A290). In addition to thirteen proposed technical changes, Holtec also proposed to reorganize the CoC and technical specifications (TS) by using the Graded Approach criteria. The Graded Approach was developed to improve the spent fuel dry storage licensing process by applying risk insights to clarify the information required in CoC and TS, and it was endorsed by the NRC in a letter dated January 8, 2020 (ADAMS Accession Package No.

ML19353D337). This is 1 of 3 applications implementing the Graded Approach after the completion of the pilot.

Miscellaneous Corrections: Final Rule; 10 CFR Chapter I [NRC-2021-0169; RIN 3150-AK70]

On November 30, 2021, the NRC published a notice in the Federal Register (86 FR 67839) amending its regulations to make miscellaneous corrections. These changes include correcting a grammatical error, punctuation, a reference, formatting, a mathematical formula, and spelling; clarifying language; revising contact information; and updating an authority citation and internal procedures. This document is necessary to inform the public of these non-substantive amendments to the NRCs regulations. This final rule is effective on December 30, 2021.

NMSS Staff Provided Updated Schedule for License Termination of the Split Rock Uranium Mill Tailings Site On November 30, 2021, the NRC staff provided an updated schedule (ADAMS Accession No. ML21335A009) to the licensee and the state of Wyoming for the licensee termination and transitioning of the Western Nuclear, Inc. (WNI) Split Rock uranium mill tailings site to the Department of Energy (DOE) for long-term care. The schedule provides the NRCs milestones for the review of the DOEs long-term surveillance plan, establishment of the long-term care fee, and the transfer of Bureau of Land Management land to DOE, all of which are necessary for the license termination of the WNI Split Rock site.

Alcohol Testing LLC in Chantilly, VA. The purpose of this contract is to procure all services necessary to conduct urine specimen collections for drug testing and occasional breath/alcohol tests in order to comply with the Nuclear Regulatory Commission Drug Testing Program requirements. The period of performance is from December 1, 2021, through November 30, 2022, with four option periods. The total potential value of the contract can be up to
