AEOD concurrence on draft letter to Ohio '

I We have reviewed the referenced draft letter to Ohio on their application for Agreement State status. We have no comment as all of our issues related to emergency response capability have been previously addressed, and we, therefore concur. However, we do have a caution as the focus of the letter relates to ,

present staffing deficiencies within Ohio. We need to assure that staffing within the Ohio radiological j health organization is sufficient to n.spond to materials emergencies before granting Agreement State status. Until Ohio fills the positions identified to carry out their obligations under the Agreement State charter,- their capabilities to respond to materials emergencies remain less than optimal.

Suppes distribution concerns discussed above; and (3) qualify the i dividual staff members per BRP-IN-100 for their areas of responsibility, or in the case f the SS&D reviewers, to demonstrate that at least two staff members meet the req irements identified in comment l number 5 in Enclosurs 1. The three commitments will be clearly identified in the Federal I Reaister notice. During the comment period, the public ill be able to comment on all aspects of the Agreement, including the adequacy of these cond' ions related to staffing. After the public comment period, we would forward the Agreeme t to the Commission for final approval, but recommend that the Chairman not sign the Agreem nt until the Bureau actually achieved adequate staffing. This approach presumes that all ot er significant issues including those ,

related to decommissioning and disposal restrictions o exempt consumer items, and any i public comments, are resolved.

The enclosed (Enclosure 2) Elapsed-day Milestone hedule provides a current estimate of the timing associated with anticipated Agreement signin and its effective date. We request your i views on this approach to completing the Agreemen , and your responses to the enclosed comments.
