RESPONSE SKEET l.

T0: SAMUEL J. CHILK, SECRETARY OF ThE COMMISSION FROM: COMMISSIONER ASSELSTINE

SUBJECT:

SECY-87-116 - EXISTING LICENSES AUTHORIZING IMPORT OF URANIUM 0F SOUTH AFRICAN ORIGIN i

APPROVED- DISAPPROVED xx ABSTAIN NOT PARTICIPATING REQUEST DISCUSSION

-I do not see the benefit of meeting with the Executive Branch and further delaying Commission consideration of COMMENTS: these matters.

I believe the Commission should:

1) As an interim measure, immediately issue an order to present license holders requiring them to notify the NRC of any proposed shipments of South African-origin uranium ore or oxide to the U.S.;
2) Adopt the OGC interpretation of Section 309 of the Anti-Apartheid Act of 1986 that imports of uranium ore and oxide of South African origin would be barred regardless of the intended end use and as such amend the existing licenses and follow this interpretation in case-by-case review of the pending and future applications; and
3) Formally inform Senator Simpson of the Edlow situation.
