From Philip Joukoff To SLU1 Dates 1/7/97 9:59pm subjects Case 4-96-056 Interview l Len, I spoke this evening with KHANDELWAL and confirmed with him the

. final arrangements for his interview on 01/09/97 at 3:00pm at the Dana Point Hilton.

During our conversation, KdANDELWAL related that he did have technical concerns that he wanted to provide to NRC. I advised him that he should be prepared to discuss these with me during the interview and he stated that these concerns were contained in the letter attachments that were previously supplied to Russ WISE and that Russ sent to me today.

NRC ADVISEMENT ON IDENTITY PROTECTION Concerned citizens in the past may have incorrectly assumed the NRC can and will protect their identities under all circumstances. Therefore, this advisement is provided to clarify the degree of protection which can be afforded to a concerned citizen making an allegation:

(1) In resolving technical issues, the NRC in protecting your identity intends to take all reasonable efforts to not disclose your identity to any organization, individual outside the NRC, or the public unless:

/ You clearly indicate no objection to being identified;

/ Disclosure is necessary to ensure public health cnd safety;

/ Disclosure is necessary to inform Congress, State or Federal Agencies in the furtherance of NRC responsibilities under law or public trust; or

/ You take actions that are inconsistent with and override the purpose of protecting your identity.

(2) For allegations involving wrongdoing, your identity MAY BE disclosed at the NRC's discretion in order to pursue the investigation.

(3) You should understand that you are not considered a confidential source unless you request such confidentiality and it has been formally granted in writing.

(4) If your allegation is that you have in some manner been discriminated j against for having raised safety concerns, it is impractical to j investigate such an allegation without using your name. Therefore, 4 for allegations of harassment and intimidation, the NRC WILL disclose (

your identity during the NRC investigation. If you request that your name be kept confidential, the NRC will normally not investigate your allegation of discrimination.

(5) Information provided under the Freedom of Information Act (FOIA) ,

will, to the extent consistent with the Act, be purged of names and j other potential identifiers.
