I have been informed by Neil Jensen in OGC that NMSS is preparing a final rulemaking that would modify Section 72.75(d)(2)(i) to add to that regulation specific reporting requirements that are being deleted from 50.73(b)(2)(J). The rationale for the NMSS rulemaking is that (i) the propsoed addition would make the reporting requirement consistent with 50.73, and (2) it is necessary for clarity.
Given that it is unclear which rulemaking will be going to the EDO and Commission first, I suggest that you prepare a statement in the SECY for the 50.72/50.73 rulemaking which identifies and discusses this issue.
