WEEK ENDING NOVEMBER 13, 1987 Oyster Creek A letter approving the restart of the Oyster Creek Nuclear Station was issued on November 6,1987. The plant had been shut down since the September 11, 1987 event which involved a Technical Specification Safety Limit Violation related to the position of the recirculation loop valves.

! Babcock and Wilcox ,

l The safety evaluation report on the NRC staff's review of the Babcock and Wilcox Owners Group (BWOG) plant reassessment program was completed on November 6, 1987. The staff has completed its review of all principal areas of the BWOG program with the exception of the reactor trip initiating events

- review, the integrated control system /non-nuclear instrumentation system review and the initiation and control system part of the emergency feedwater '

l system review. These arets are currently under review ar.d will be evaluated in a supplement to the SER which is currently scheduled for issuance in January 1988.

i BWR-MARK I Containment Melt-Through Task Group Meeting A Task Group has been fonned to review the BWR-Mark I containment .

1 melt-through issue. A meeting was held November 9, 1987 in Bethesda with l NRC contractor personnel to review the issue and assign contributing i l efforts. The objective of the group is to provide a position paper to aid the NUREG-1150 risk experts in properly reassessing Mark I containment melt-through. The paper will include discussions of supporting analyses of melt spreading and attack of the dry well wall with and without the presence .

William Olmstead (OGC) will be the NRC's principal negotiator at this meeting.

OFFICE OF NUCLEAR REACTOR REGULATION ITEMS OF INTEREST Week Ending November 13, 1987 Oyster Creek A letter approving the restart of the Oyster Creek Nuclear Station was issued on November 6,1987. The plant had been shut down since the September 11, 1987 event which involved a Technical Specification Safety Limit Violation related to the position of the recirculation loop valves. l P_ilgrim On November 9, 1987 Ralph Bird (Senior Vice President - Nuclear) issued a l stop work order for maintenance and modification activities at Pilgrim.

This was in response to his determination that the BEco standards of excellence were not being met by onsite personnel as indicated by several incidents occurring over the weekend. These incidents include (1) taped  ;

over lock on a high radiation area door on the refueling flocr; (2) the j removal of ductwork by maintenance personnel that would have led to a breech in a vital area barrier; (3) a small radioactive spill caused, in j part, by the installation of a RHR valve (part of Safety Enhancement Program modification to provide cross-connect between RHR and fire water systems) without any packing; and (4) a missed RPS surveillance. 1 None of these incidents appear tc have resulted in an actual event with safety consequences nor does there appear to be any direct linkage between the incidents. BEco management has sent GE and Bechtel craft personnel home until November 12. BECo is evaluating the incidents and developing an action plan to deal with these issues. The resident inspectors are following the licensee's actions.

The facility has been shutdown since April 1986 due to management, emergency planning, and technical issues. BECo recently completed core reload and vessel reassembly.

Babcock and Wilcox The safety evaluation report on the NRC staff's review of the Babcock and Wilcox Owners Group (BWOG) plant reassessment program was completed on November 6, 1987. The staff has completed its review of all principal areas of the Bk'0G program with the exception of the reactor trip initiating events review, the integrated control system /non-nuclear instrumentation system review and the initiation and centrol system part of the emergency feedwater system review. These areas are currently under review and will be evaluated in a supplement to the SEP which is currently scheduled for issuange in January 1988.

Dry Spent Fuel Storage By letter dated November 3, 1987, NMSS staff received a topical report from.

Nuclear Packaging, Inc. entitled, " Topical Safety Analysis Report for the l NuPac CP-9 Concrete Storage Cask." The NuPac CP-9 cask weighs 91 tons fully  !

loaded and has a capacity of 9 PWR spent fuel assemblies with a minimum age of 1 10 years. The inner cavity of the cask is steel lined with welded closure j seals. A helium cover gas is maintained during storage. The cylindrical cask has a height of about 17'8" and a diameter of 8'O . It is designed to-be. j loaded in a reactor pool or, alternatively, to be dry loaded outside the pool l using a single assembly fuel transfer cask in a fashion similar to that used d for the NuPac 125B shipping cask.

1 A member of the Safeguards' Licensing Branch is in Vienna, Austria'as the NRC representative to the US/IAEA negotiating team. Facility Attachments are being negotiated for the. application of IAEA safeguards at the General Electric LEU fuel fabrication facility at Wilmington, North Carolina. 1 High-level Waste Management Negotiated Rulemaking for Licensing Support System for HLW-On November 19 and 20, 1987, the Licensing Support System Advisory Committee (LSSAC) will meet in Denver,' Colorado. This meeting will mark the actual beginning of negotiations on the issues pertaining to the use of the LSS.

Center for Nuclear Waste Regulatory Analysis Status Report <

The preliminary draft of the Operations Plan for the Center for Nuclear Waste -

Regulatory Analysis was received from the FFRDC Contractor (Southwest Research .

Institute) on November 10, and is under review this week by the Program Managers. A meeting with Southwest Research Institute is expected to take' place on November 16, following review of the Operations Plan.

elicitation meetings taking place in December and January as part of that review.

OFFICE OF PERSONNEL ITEMS OF INTEREST Week Ending November 13, 1987 SES Conference The second Senior Executive Service Conference was held in Baltimore on November 9 and 10, with over 80 participants. The success of the first meeting was reflected in greater interaction between Senior Executives and top NRC managers. The third and final conference of this year is scheduled for November 23 and 24.

Career Counseling A new contractor began NRC's career counseling program last spring. The first report, covering March through September indicates 174 employees participated in career counseling in Headquarters and the Regions. Employees ranged from GG-5 to GG-15, from ages under 21 to over 60, from high school graduates to PhD's, with length of service of less than 1 year to over 20 years. J Participants sought help in such areas as assessing career choice and direction, deciding whether to pursue the management or technical track, identifying employment opportunities, writing resumes and interview .

Health Benefits Open Season The Federal Employees Health Benefits Program 1987 open season began on November 9 and will continue through December 11. Employees were notified via yellow announcement dated October 29, 1987. In addition, employees received an Enrollment Guide and Plan Comparison Chart to aid them in selecting a health care plan suited to their needs. Individual booklets were made available to employees through their Administrative Contacts.

Thrift Plan Open Season The first Thrift Savings Plan (TSP) Open Season for 1988 will begin on November 15, 1987 and run through January 31, 1988. Employees were notified  ;

via a yellow announcement dated November 10, 1987. Open Season Booklets were also distributed via the Agency mail system and enrollment forms were made available to employees through their Administrative Contacts.

TSP withdrawal packages were provided to Headquarters Staffing personnel and Regional Personnel Offices to be given to employees who separate from Government service. These forms will enable employees to transfer their contributions to an IRA, to withdraw their account balance, or to receive their balance in the form of an annuity. l The interest rate for the month of November for the "G" fund is 9%.

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending November 13, 1987 Incident Response On November 12, 1987, the Incident Response Branch (IRB) staff and Region V participated in a conference call concerning the Rancho Seco Full-Scale Exercise.

Technical Training The TTC Director met with representatives from GPA and NMSS on 11/3/87 to discuss budgets and technical training curricula in common or potentially common areas.

Initial exploration of the GPA curriculum for State personnel and the existing and planned curriculum in the materials safety area,' being worked jointly by the TTC and NMSS, has led to some potential areas of economy within the Agency. It seems cost effective for NRC materials inspection and licensing personnel to attend certain existing courses within the GPA curriculum which already have a materials emphasis. It also seems cost effective for the TTC to maintain the only commercial contract for radiography training, expanding the scope such that both NRC and State personnel can attend. A GPA member has been added to the Training Advisory Group (TAG).

The TTC Director met with representatives of all of the NRR divisions on 11/4/87 to discuss the progress made in identification of qualification requirements and technical training needs of NRR in general and the means of satisfying the NRR reactor technology training needs in specific. Plans for new lines of courses, including course objectives, potential topics, and potential times, were explained and prctided to the NRR staff. One new line consists of a 2 week Reactor Technology and Operations (RTO) Course followed by a 1 week RTO Simulator Course.

The other new line consists of a I week NSSS Technology Course followed by a 1 week RTO Simulator Course. The second line is specifically designed for personnel, already trained in one reactor technology, who need training in a second reactor technology. Both new lines can be made available for the General Electric, Westinghouse, Babcock and Wilcox, and Combustion Engineering designs during FY88.

Diagnostic Evaluation and Incident Investigation The McGuire Diagnostic Evaluation team met on November 9-10, 1987 to review and l discuss background information in preparation for the team site and corporate evaluation activities. The meeting included presentations on NRC staff I perspectives from Region II, NRR and AE0D which involved the Catawba quality assurance inspection, performance indicators, operating experience reviews, and SALP results.

1. On November 13, 1987, Region IV management met with Nebraska Public Power District representatives concerning the security program at Cooper Nuclear Station.

l 2. Atlas Corporation has responded to the Commission's Order of July 31, 1987, which called for the submittal of a surety along with a facility-decommissioning plan and commencement of site reclamation upon approval of the plan. On October 30, 1987, Atlas submitted evidence of a surety in the form of a Letter of Credit in the amount specified in the Order.

However, the staff will require Atlas Corporation to revise the Letter of Credit to fully incorporate.the provisions of Criteria 9. Appendix A, 10 CFR Part 40 relative to non-renewal of the Letter of Credit. Atlas Corporation was granted an extension of submission of the facility decommissioning plan until November 30, 1987. It remains unresolved whether Atlas will file a new application for license upon completion ,

of the requirements of the Order or will commence facility decommissioning.

SECY-87-257 - Emergency Planning Rule l The Commission, by a 5-0 vote, approved revisions to NRC's emergency planning rule, establishing procedures for evaluating the adequacy of emergency planning at the operating license review stage in situations in which state and local government officials decline to participate in emergency planning. The revisions provide for adopting the proposed rule as published for public comment on March, 1987, with modifications and clarifications consistent with Commission testimony, responses to Congresc on the intended scope and effect of the rule, and Commissioners' comments. The rule recognizes that though state and local participation in emergency planning is highly desirable, and indeed is essential for maximum effectiveness of emergency ,

planning and preparedness, Congress did not intend that the  !

absence of such participation should preclude licensing of j substantially completed nuclear power plants where there is a utility-prepared emergency plan that provide reasonable assurance of adequate protection to the public.

The Commission, by a 5-0* vote, approved an order which con-cluded its review of three issues in'ALAB-832. The order reversed the Appeal Board's decision in ALAB-832 in so far as it admits Contentions 22.B and 22.C for hearing, but directs the NRC staff to advise the Commission prior to issuance of any J.icense above 5 percent power whether there are any special' circumstances at Shoreham that were not envisioned in the emergency planning rulemaking that would make'it inappropriate to apply to Shoreham the generic decision that an-EPZ of about 10 miles is adequate for emergency planning purposes. Secondly, the order upholds the Appeal Board's decision in ALAB-832 that the proceeding must be remanded to correct an error regarding the need for evacuation plans for hospitals in the EPZ.

dated 11/13/87 The Commission **was briefed by the staff on the status and ongoing efforts to meet NRC's Congressional mandate to license DOE's high level radioactive waste repository.

The staff outlined its schedule for submitting the following items for Commission consideration:

1. Rulemaking package on definition of high level waste.
  • Section 201 of the Energy Reorganization Act. 42 U.S.C.S5841, provides that action of the Commission shall be determined by a

" majority vote of the members present." Commissioners Bernthal.

and Rogers were not present when this item was affirmed.

Accordingly, the formal vote of the Commission was 3-0 in favor of the decision. Commissioners Bernthal and Rogers,.however, had previously indicated that they would approve this paper and had they been present they would have affirmed their prior votes.
