SUBJECT:
REVIEW AND COMMENT ON DRAFT NATIONAL DAM SAFETY BIENNIAL
. REPOR.T FOR 1998-1999- .
Dear Mr.- Bathurst:
< .On September 22,1999, you requested that the U.S. Nuclear Regulatory Commission (NRC)-
review and comment on the draft National Dam Safety Biennial Report for 1998-1999. The Report presants information which the Federal Emorgency Management Agency (FEMA)
L recently acquired from member organizations of the Interagency Committee on Dam Safety (ICODS) and from the various state agencies which deal with dam safety issues. The NRC, which is a member of ICODS, submitted its input to your office on July 26,1999.
Le :The draft Report accurately identifies the number and type of dam structures in NRC's -
progrsm on page 13.
ei lOn page 33 of the Report, FEMA requests that NRC "..should continue the initiatives Jdescribedin the current Progress Report and should ensure that the dams underits.
jurisdiction are periodically re-inspected and the hazard classification reviewed." We wish y to report that our program is proceeding such that'all dams will be re-inspected every 2
~ to 3 years.1The hazard classification is_ reviewed at each re-inspection,~or more often if '
1 dictated by licensee actions which may'be related to dam safety. Thus, your directive is -
s being followed by the NRC. We note that a typographical error occurs in line 8 of l paragraph 3 on page 33, under the heading " Nuclear Regulatory Commission."
< .'~
- ^The NRC dam safety' program funding, as summarized on page 34 of the Report, is accurate.
t e ( As .statsd on page 35 of the Report, NRC staff continued to receive additional training in
- the geotechnical and hydraulic disciplines related to the performance of enibankment .
? dams in 1998-1999. 6.

With respect to emergency action plans (EAP), the Report correctly notes on page 43 the p-
- eL i
. Iow-hazard classification status of all NRC dams. Although EAPs are not requir.ed for low-y
,; hazard dams, the' NRC has confirmed that assistance with EAP planning is available from the' Federal Energy Regulatory Commission (FERC), if required. i t

D. Bathurst Finaliy, the $ummary Status of Dams, Dam inventory Table, appended to the Report, correctly states the number of dams in NRC's program, along with the confirmation of 12 inspections during the report period. However, the table does not show that the 12 (site) inspections covered all 19 structures in NRC's program, thus all dams were re-inspected by NRC in 1998-1999. Three NRC sites have multiple dams.
The NRC appreciates the opportunity to provide these comments on the draft Report. If you have any questions regarding NRC's dam safety program, please call Daniel Rom at 301-415-6704.
