FINAL RULE - ELECTRONIC FREEDOM 0F INFORMATION ACT IMPLEMENTATION i

l Final Rule Sianed by the CIO j On December 31, 1997, the Acting Chief Information Officer approved a final rule entitled " Electronic Freedom of Information Act: Implementation." The final rule amends 10 CFR Part 9. Subpart A. Freedom of Information Act Regulations to implement recent amendments to the Freedom of Information Act '

(F0IA).

Backcround:

The Freedom of Information Act. 5 U.S.C. 552, was amended and signed into law on October 2. 1996 by President Clinton. The amended act is known as the Electronic Freedom of Information Act Amendments of 1996 (EF01A). The amendments to the FOIA are designed to bring the Act into the information and '

electronic age and to improve responsiveness to FOIA requesters. The amendments also increase the time allowed for agencies to respond to FOIA requests.

The final rule will:

l

1) implement statutory provisions of the EFOIA that 'r equire certain categories of agency records to be made publicly available electronically.
2) change the statutory time for responding to requests from the 10 working days formerly required and extend that time to 20 working days.
3) establish procedutes for collaborating with requesters to tailor requests in a way that will enable NRC to be more responsive to the requester.
4) amend NRC's F0IA regulations to comply with the requirements of the new statute.
5) make minor editorial and technical changes to make the regulation more accurate and readable.
