REQUEST FOR COMMENT AND CONCURRENCE ON A FINAL RULE ENTITLED " ELECTRONIC FREEDOM OF INFORMATION ACT: IMPLEMENTATION" 10 CFR PART 9 The Office of the Chief Information Officer has reviewed the subject final rule for Paperwork Reduction Act implications and concurs in it. However, pleaue replace the attached Paperwork Reduction Act Statement (PRAS) to reflect our conclusion that the rule contains information collection requirements which are insignificant, and therefore, will not be sent to the Office of Budget and Management for approval. We have placed publication of this rule on hold with the Office of Administration periding the correction to the PRAS.

- The final rul6 includes an information collection requirement that persons seeking expedited processing under 10 CFR 9.25 (e)(2) should certify the reasons justifying their request. The 1

estimated burden for this certification is one hour por request, with approximately 20 requests l expected annually. The NRC does not consider this burden increase of 20 hours2.314815e-4 days <br />0.00556 hours <br />3.306878e-5 weeks <br />7.61e-6 months <br /> to be significant enough to trigger the requirements of the Paperwork Reduction Act when compared to the overall burden for this 10 CFR Part and when the amount of staff effort required to comply with requiremer;ts of the Paperwork Reduction Act and seek OMB's implementing guidance is factored in. Existing requirements were approved by the Office of Management and Budget, approval number 3150-0043.
