NRC INSPECTION REPORT 999-90004/98-02 AND NOTICE OF VIOLATION

Dear Mr. Mickle:

On May 12-14,1998, the NRC conducted an inspection at your Tulsa, Oklahoma, facility. The '

inspection included a review of activities involving the unlicensed possession and use of an x-ray fluorescence probe. A telephonic exit briefing was subsequently conducted with you on June 3,1998.

Within the scope of this inspection, one violation vns identified. The violation involved the possession and use of an x-ray fluorescence probt containing 10 millicuries of cadmium-109 and 44 millicuries of iron-55 without a valid NRC license. The inspection disclosed that Word Industries (WI) had received the device on December 1,1997. WI had assumed that since they were generally licensed for similar devices, it would be acceptable for WI to receive the probe from another generally licensed entity.10 CFR 31.5 requires, in pait, that generally licensed devices, following the irut!al transfer from a manufacturer or vendor, only be transferred to persons holding a specific license to receive the device, or to a general licensee where the device remained in use at a particularlocation. Since the original owner of the probe transferred the device from Louisiana to Wl's Oklahoma facility, WI was required to hold a specific license for the probe. At the time of the inspection, WI did not maintain a specific license authorizing the x-ray fluorescence probe. On May 14,1998, WI transferred the probe to Metorex, Inc., the device manufacturer, f

required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. For your consideration and convenience, NRC Information Notice 96-28, " SUGGESTED GUIDANCE RELATING TO DEVELOPMENT AND IMPLEMENTATION OF CORRECTIVE ACTION,"is enclosed. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its 'i enclosures, and your response will be placed in the NRC Public Document Room (PDR). To the i extent possible, your response should not include any personal privacy, propr!etary, or l safeguards information so that it can be placed in the PDR without redaction.
