ORDER IMPOSING CIVIL MONETARY PENALTY This refers to your letter of May 6,1986 in response to the Notice of Violation and Proposed Imposition of Civil Penalty (NOV) sent to you by letter dated April 16, 1986. The NOV described violations found during a routine NRC safety inspection conducted January 1-31, 1986 of activities authorized by NRC Operating License NPF-38 for your Waterford Steam Electric Station, Unit 3.

We have completed our review of your response to the vio.lation assessed a civil penalty (Violation I) in which you admit that the violation occurred as stated in the NOV. However, you request mitigation of the proposed civil penalty and further request that the violation be reclassified at a Severi'ty Level IV.

After careful consideration of your response, we have concluded, for the reasofis given in the Appendix to the enclosed Order, that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and that you did not provide. in your response a sufficient basis for either mitigation of the proposed civil penalty or reclassification of the violation to Severity Level IV. Accordingly, we hereby serve on Louisian) Power and Light Company the enclosed Order Imposing Civil Monetary Penalty in the amount of Fifty Thousand Dollars ($50,000).

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosed Order will be placed in the NRC's Public Document Room.
