In response to your appeal, the documents withheld pursuant to these request were re-reviewed. Accordingly, l* affir'm the Agency's initial action with regard to all of the documents.

The documents or portions of documents withheld pursuant to Exemption 5 of the Freedom of Information Act (FDIA) are part of the Commission's

' predecisional precesses. The purpose of the deliberative process privilege is to " prevent injury to the quality of agency decisions." NLRB v. Sears.

Roebucl: L Co., 421 U.S. 132, 151 (1975). Disclosure of these prececisional documents would be likely to " stifle honest and frank communication within the agency." Coastai States Gas Corp. v. Department of Eneray, 617 F.2d 854, 866 (D.C. Ci r. 19EO) . Aaditionally, Documents 7 and 13 cn Appendix D are drafts.

Portions of Document 3 on Appendix B were withheld pursuant to Exemption 7(A) of the FOIA. The enforcement proceeding referred to in cur March 7 letter is ongoing and release of these portions of Document 3 would interfere with it that proceeding.

This letter represents final agency action on your March 19, 1986 F0IA Appeal. Judicial revicu of the denial of documents is aveilable in Federal district court in the district in which you reside er have your principal place of business, or in the District cf Columbia.

Dear Ms. Garde:

This is in partial response to your letters dated January 13, 20 and 27,1986, which were received in this office on January 28, 1986,.in which you requested, pursuant to the Freedom of Infomation Act (F0IA), documents generated or-prepared by Victor Stello since his appointment as Acting Executive DirectoY for Operations. In a telephone conversation with Carol Ann Reed of my staff on January 28, 1986, you narrowed the scope of your request to 1) handwritten and typed notes of V. Stello; 2) notes and correspondence dictated by V. Stello;

3) records reflecting V. Stello's decisions and comments, and the records upon which the decisions and coments were based; 4) correspondence and other records prepared by V. Stello's staff which carry out.a V. Stello directive; and 5) SECY papers signed by V. Stello.

The documents listed on the enclosed Appendix A are being placed in the NRC Public Document Roo'n (POR),1717 H Street, NW, Washington, DC. You may obtain access by presenting a copy of this letter to the PDR staff or by requesting PDR folder F0IA-86-53 in your name.

p Documents one, two and enclosures "d' and "e" of document three as listed on the enclosed Appendix B are being with5 eld in their entirety, and portions of the documents listed on the enclosed Appendix C are being withheld pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. These are drafts of documents or documents which contain advice, opinions, and reconrnendations. Release of this type of information would tend to inhibit the frank and candid exchange of informa1! ion in future deliberations and thus would not be in the public interest. Tiere '

, because release of the facts would pemit an indirect inquiry into the l predecisional process of the agency. The nonexempt portions of the Appendix C l documents are being placed in the PDR. '

The remaining portions of document three.as listed on enclosed Appendix B are

being withheld in their entirety pursuant to Exemptio'n (-7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A)) and 10 CFR 9.5(a)(7)(1) of the Commission's regulations.

The release of this infomation would interfere with 'an ongbing enforcement l- proceeding.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been detemined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this dental is Mr. Victor Stello, Acting Executive Director for Operations.
