This is in response to your request, dat.cd January 22, 1987, for a partial exemption from 10 CFR 70.57(b)(3) and concomitant commitments in the General Electric Fundamental Nuclear Material Control Plan for the receipt of low enriched uranium UF6 from Russia. We have reviewed your request and have determined that granting it will not adversely affect the comon defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are issuing a new License Condition 4.9 to Amendment SG-1 to your License No. SNM-1097, effective immediately, to read as follows: 4.9 Notwithstanding the requirements of 10 CFR 70.57(b)(3) and g Sections 1.2.3, 1.8.5, 4.3.1.1, 7.9.1, and C-4.3.3 of the Plan identified in Condition 2.1 concerning (1) a representative to witness UF6 withdrawal weighing and sampling, and to apply tamper-safe seals at the diffusion plant and (2) annual reviews and audits of UF6 sampling activities for LEU UF6 receipts from Russia, the licensee shall follow the commitments in the attachment to the General Electric letter of January 22, 1987, for LEU UF 6 received from Russia. We have determined that the attachment to your January 22, 1987 letter contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.12.
