APPENDIX A Zetec, Inc.

Docket No. 99901037/85-01 NOTICE OF VIOLATION As a result of the inspection conducted on December 9-13, 1985, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and.

its implementing regulation 10 CFR Part 21, the following violations were identified and categorized in accordance with the NRC Enforcement Policy (10 CFR-Part 2, Appendix C), 49 FR 8583 (March 8, 1984):

1. Section 21.6 of 10 CFR Part 21 dated May 31, 1984, states, in part,-

"(a) Each... corporation... subject to the regulations in this cart, shall post current copies of the following documents in a con:,picuous position...(1) the regulations in this part, (2) Section 206 of the Energy Reorganization Act, and (3) procedures adopted pursuant to the regulations in this part."

Contrary to the above, copies of Section 206 of the Energy Reorganization Act and Procedure No. ZAG-16 " Reporting of Safety Hazards" were not posted along with a copy of 10 CFR Part 21 posted in the main building, and none of the documents were posted in another building containing the Machine Shop and Specialty Shop. This is a Severity Level V violation (Supplement VII).

2. Section 21.31 of 10 CFR Part 21, dated May 31, 1984, states, in part, "Each... corporation... subject to the regulations in this part shall assure that each procurement docurent for a... basic component...

specifies, when applicable, that the provisions of 10 CFR Part 21 apply."

Contrary to the above, Zetec did not pass on the requirements of 10 CFR Part 21 to Westinghouse Specialty Metals Division who supplied inconel tubing to Zetec in August 1982. The tubing was fabricated into a calibration standard and shipped to Rochester Gas & Electric (ref. Purchase Order.N-EG-45426 dated September 5, 1984 which imposed Part 21 requirements upon Zetec).
