Gentlemen:

SUBJECT: ORDER IMPOSING CIVIL MONETARY PENALTIES

This refers to your letter dated October 18, 1985 in response to the Notice of

Violation and Proposed Imposition of Civil Penalties sent to you by letter

dated September 9,1985. The Notice of Violation describes violations found

during a special NRC safety inspection conducted at your facility and at a field

site June 21 through July 16, 1985.

In your response you admitted certain violations, denied others, and gave reasons

why you believe the prcposed civil penalties should be mitigated. After

careful consideration of your response, we have concluded, for the reasons set

forth in the enclosed Order and Appendix, that a sufficient basis was not

provided for withdrawal of any of the violations. However, the NRC staff

concluded that because of your prompt identification and reporting of the

overexposure violation, a Four Thousand Dollar ($4,000) reduction of the

cumulative civil penalties would be appropriate. Accordingly, we hereby serve

the enclosed Order on Calumet Testing Services, Incorporated imposing civil

penalties in the cumulative amount of Twelve Thousand Dollars ($12,000).

The corrective actions described in your response will be reviewed during a

subsequent inspection.

In accordance with 10 CFR 2.790, of the NRC's " Rules of Practice," Part 2,

'

Title 10, Code of Federal Regulations, a copy of this letter and the enclosures

will be placed in the NRC's Public Document Room.

The responses directed by this letter and the enclosed Order are not subject to

the clearance procedures of the Office of Management and Budget, as required by

the Paperwork Reduction Act of 1980, PL 96-511.
