Vice President Nuclear Edison Plaza 300 Madison Avenue Toledo, OH 43652 Gentlemen: s This is to acknowledge receipt of Revision 9 to the Davis-Besse Nuclear Power Station Emergency Plan, dated July 1985.

We have completed our review of the submitted changes and a letter dated

' September 30, 1985 (Serial No. 1-580) which clarified the plan's commitment regarding the intended use of Shift Technical Advisors as interim Emergency Duty Officers. We have also discussed with your staff the status of Revision 10 to the plan, which we understand would contain any significant changes to the onsite emergency organization's structure which are currently being considered. We have determined that the changes contained in Revision 9 are consistent with the requirements of 10 CFR 50.54(q), do not decrease the effectiveness of the plan and are, therefore, acceptable.

We have reviewed your revised procedures which indicated that, following the declaration of any emergency class, the Station will directly notify representatives of both State and county governmental agencies who are available 24-hours per day. This commitment must be clearly stated in the next revision to the Emergency Plan.

Please be reminded that 10 CFR 50.54(q) requires NRC approval of any changes to your emergency plans which may decrease their effectiveness. However if your safety review assures no decrease in emergency preparedness effectiveness, then such changes may be made and implemented without prior NRC approval. In all cases, you must furnish copies of each proposed change to the NRC in accordance with 10 CFR 50.54(q). Also any changes to the Emergency Plan ,

Implementing Procedures should be made in accordance with the requirements t of 10 CFR Part 50, Appendix E, Section V. ,

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter will be placed in the NRC's Public Document Room.
