Dear Mr. Shelton:
This will acknowledge receipt of your check for $1,000 in payment of a civil penalty as per the Settlement Agreement approved by the Atomic Safety and Licensing Board on October 1, 1996 (copy enclosed).
I am taking this opportunity to remind you of the provisions of the Settlement Agreement. Pursuant to 10 CFR 150.20, you are required to file NRC Form-241 before conducting licensed activities in NRC jurisdiction. Following the submittal of a yearly Form-241 to NRC, the Settlement Agreement requires that you notify NRC Region II, by 9:00 a.m. EST Monday of each week (or Tuesday, if Monday is a Federal holiday), whether or not you plan to perform radiography work in areas under NRC jurisdiction. This provision of the Settlement Agreement remains in effect until October 31, 1998. The Settlement Agreement provides the required form and a facsimile telephone number for making the notification.
The Settlement Agreement contains other requirements as well. You should review the Settlement Agreement and ensure that you continue to follow the requirenents contained in it. Your compliance with NRC requirements and the terms of the Settlement Agreement will be examined during future inspections.
