NOTIFICATION REQUIREMENTS OF SETTLEMENT AGREEMENT
Dear Mr. Shelton:
On September 10. 1996, a Settlement Agreement Concerning An Order Imposing Civil Monetary Penalty and Order Prohibiting Involvement in NRC-Licensed Activities (Order), was reached between you on behalf of TESTCO. Inc.. and the Nuclear Regulatory Commission (NRC). Under the provisions of Section 3 of the Order, you were required to notify the NRC Region II Office by Monday morning of each week whether TESTC0. Inc. )lans to perform radiography work in areas under NRC jurisdiction. until Octo>er 31, 1998.
By facsimile of July 6,1998 you stated that TESTC0. Inc. has no plans to aerform radiography work in areas under NRC jurisdiction through October 31. 1998.
Because of this, you requested that TESTC0. Inc. be released from the requirement to report planned radiography work in areas under NRC jurisdiction.
Based on your request and your statement that no work is planned, the NRC has determined that the provisions of Section 3 of the Order will be satisfied by your submitting in advance, a one-time notification.
This one-time notification must include the completed form referenced in Section 3 of the Order to cover the time period through October 31, 1998, indicating that TESTCO Inc. has no plans to perform radiography work in areas under NRC jurisdiction. However, should your intentions change such that you plan to perform radiography in areas under NRC~ jurisdiction any time prior to October 31, 1998, you must notify the NRC of these intentions in accordance with the provisions of Section 3 of the Order.
