MINUTES OF THE 88TH MEETING OF THE ADVISORY COMMITTEE ON NUCLEAR WASTE NOVEMBER 1213,1996 ROCKVILLE, MARYLAND J
- The 88th meeting of the Advisory Committee on Nuclear Waste (ACNW) was held at the Two White Flint North Building,11545 Rockville Pike, Rockville, Maryland, on November 12-13,1996.
The purpose of this meeting was to discuss and take appropriate actions on the items listed in the attached agenda. The er. tire meeting was open to the public except for a portion that dealt with organizational and personnel matters.

Dr. Paul W. Pomeroy, Committee Chairman, convened the meeting at 8:40 a.m. and briefly reviewed the schedule for the meeting. He stated that the meeting was being conducted in conformance with the Federal Advisory Committee Act. He also stated that the Committee had not received any requests from persons or organizations desiring to make an oral statement
, during the meeting. However, he did invite members of the public who were present and had something to contribute, to inform the ACNW staff so that time could be allocated for them to make oral statements.

Dr. Pomeroy identified a number of items that he believed to be of interest to the Committee, !
including the following:
e On October 3, the Southeast Compact Commission for Low-level Radioactive Waste .
Management voted to provide up to $6.5 million in additional funding for activities of the >
North Carolina Low-Level Radioactive Weste Management Authority and its contractors.
(The work had been stopped since early July.)
e On October 23, the National Research Council published a report entitled "The Waste isolation Pilot Plant: A Potential Solution for the Disposal of Transuranic Waste," in which it stated " Scientific analyses indicate that the WIPP repository has the ability to isolate transuranic waste for more than 10,000 years, provided it remains undisturbed by human activity."
e The Department of Energy (DOE) has decided not to challenge a July 1996 order from the U.S. Circuit Court of Appeals that ruled that the govemment is obligated to take radioactive spent nuclear fuel now at reactor sites and store it at a centralized facility !

o On October 18 the Texas Natural Resource Conservation Commission (TNRCC) declined to process the Envirocare of Texas, Inc.'s application to construct and operate a disposal facility for mixed and hazardous waste in Andrews County, citing that Texas i

l e Waste Control Specialists, Inc., which owns a 16,000 plus acre tract of land (also in Andrews County) has an application p inding with the TNRCC to operate a technology commercialization facility on the site that it claims will have the following " future capabili-l ties": (1) treatment and storage of LLW: (2) disposal of Federal-facility LLW, and (3) disposal of by-product materials including 11e(2) mine and mill tailings. Within the 16,000 acre site it currently operates a 1,338 acre licensed landfill and also has a permit l l
to process hazardous waste.

- On November 3, Dr. William D. Travers, Director of the Spent Fuel Project Office, assumed responsibilities for direction of the Special Projects Office established to provide oversight, inspections, and licensing actions associated with the Millstone and Haddam Neck sites operated by Northeast Utilities.
II. ACNW INTERNAL OPERATIONS (Open)
(Mr. Richard Major was the Designated Federal Official for this day, except for the closed session on new members when Dr. Richard Savio was the Designated Federal Offic:al.)
The ACNW spent this day concentrating on the intemal operations of the Committee.
Topics considered during the day included the following: a strategy for ACNW reviews, independent functioning by ACNW and future attematives, priority issues for the next year, the qualifications of new members (closed session), communications with the Commission, a review of the National Research Council's report, " Rethinking High-Level Radioactive Waste Disposal," and ACNW actions related to the Commission's Direction-Setting issue (DSI) papers.

l A. A Strategy for ACNW(Open) -l Dr. Garrick led a discussion on a strategy fo. the ACNW which would identify actions to move the Committee into the best possible position to proactively give
)
l advice to the Commission. The strategy would be based on a risk-informed, !
l performance-based approach to regulation, a recognition of the development of i new standards and regulations for high-level waste (HLW) disposal, and the goal l of assurance that nuclear waste is managed safely.
l Criteria for establishing priorities were set. These were the following:
e An understanding of NRC's strategic plan, including trends and directions j l in regulatory practice, such as the adoption of a risk-informed, perfor-mance-based method of regulation.
- A clear understanding of the strategy and activities of licensees and applicants.
e The scientific and technical basis of information supporting the safety and performance assessments of nuclear waste disposal facilities, including the quality and level of technical expertise involved.
- The timeliness of the ACNWs advice with respect to effective decision
- making in the regulatory process.
Issues that were a part of the intersection of these four criteria would be placed on the ACNW priority list. I 4

B. INDEPENDENT FUNCTIONING BY ACNW (Opan)
The ACNW members discussed the merit of whether or not the ACNW should recombine with the ACRS as a stand-alone subcommittee. It was generally l.
agreed that for the present time, the preferred option was for the ACNW to
- remain an independent committee. It was suggested that efforts be continued in !
l trying to establish a joint ACRS/ACNW subcommittee to review issues of con-i com to both Committees. The topic of merging the two Committees would be an ideal topic for the joint subcommittee. Another option mentioned was to increase the number of members on the ACNW, broadening the areas of expertise, but holding fewer meetings. The aim was a committee with greater expertise, but at l the same cost as the present ACNW.
I The Committee discussed revisions to its charter, but agreed not to make any f changes at the present time.

- D. Rethinkina Hinh-Level Radioactive Waste Disposal (Open) l Dr. Homberger discust ed the 1990 National Research Council's report, "Re-
- thinking High-Level Radioactive Waste Disposal." Dr. Homberger was a mem-l ber of the Board on Radioactive Waste Management that produced the report.
In 1988, the Board held a retreat to discuss issues associated with HLW dis-posal. Initially the report was to be proceedings of that retreat; it finally evolved into the existing report. The main point of the report is that flexibility and the ability to shift direction will be needed to construct an HLW repository.
Repository development was compared to mining operations. ~ In mining, it is l 1
! necessary to switch plans once underground and actual conditions in the rock become known. In mining, the axiom exists, you won't get it right the first time.
Similar axioms might apply to underground radioactive waste disposal. Con-gross and DOE were urged to set a realistic licensing schedule. It was further recommended that the Environmental Protection Agency explore the use of a dose-based standard.
E. GemmuniGatim(Open)
Ms. Lynn Deering, ACNW staff, recently completed a 4-month rotational assign-ment in Commissioner Rogers' office. Based on this experience, Ms. Deering of-fered some suggestions to increase the effectiveness of the Committee's communications with the Commission. On of the principal perceived benefit of

an advisory committee is its ability to prnduce ACNW advice based on the members' perspective from outside the Agency. It was suggested that prepara-tion for public meetings between the Committee and Commission receive greater attention. The members were encouraged to offer additional individual com-ments in their letter reports when appropriate, so that the Commissioners would get a sense of the diversity of viewpoints.
F. Priority lasues (Open)
The Committee reviewed items that would be placed on its priority list. During the meeting a priority list for 1997 was completed.

The Committee completed work on two reports which will be issued in the near future. The reports were the following: " Screening Methodology for Assessing Prior Land Burials of Radioactive Waste Authorized Under Former 10 CFR 20.304 and 20.302,"_ dated November 20,1996, and "1997 Priority issues for the Advisory Committee on Nuclear Waste," dated November 20,1996. ,
B. Euture.MeetingAgenda Appendix IV summarizes the proposed items endorsed by the Committee for the 89th ACNW Meeting, Rockville, Meryland, January 28-30,1997, and future Working Groups.

The Committee discussed agendas for their January and February 1997 meet-ings. The Committee also asked its staff to prepare a short history of the ACNW. l l
The purpose of the history is to facilitate acquainting new Commissioners with the ACNW. !

In a closed session, the ACNW members discussed possible candidates for membership on the Committee. Several candidates were identified and will be invited to the 89th ACNW meeting (January 28-30,1997) for an interview.

i Preoaration for Meetino with Commission -The Committee will prepare for their next meeting with the Commission. This meeting is currently scheduled during February 1997.
