I disapprove of proceeding with the proposed rule as described under Option 3 in SECY-97-045. Instead, I recommend that the proposed rule be withdrawn (0ption 1). i Public comments on the proposed rule made it clear that the costs of implementing the proposed rule, particularly the reporting requirements, outweigh the benefits that might result from the rule. Furthermore, the events that the proposed rule were intended to cover would be more appropriately handled by law enforcement agencies rather than the NRC. Therefore, I recommend that the proposed rule be withdrawn.
