I NOTICE OF NPDES PERMIT DETERMINATIONS COMPANY: Tennessee Valley Authority IOCATION: 126 In ust Street Building, Knoxville, TN DISCHARGE POINT IDCATION: Sequoyah Nuclear Plant, Tennessee River Mile 484 Hamilton County, Tennessee NPDES PERMIT NO.: 'IN0026450 PERMIT EFFECTIVE DATE: April 1, 1983 After due consideration of the facts applicable to the above-named facility and the requirements and policies expressed in the Clean Water Act and appropriate regulations, I have determined that the National Pollutant Discharge Elimination System permit should be issued with no substantial changes from the tentative determinations previously announced.

We adninistrative record, including application, fact sheet and/or draf t permit, a sketch showing the exact location of the discharge, connents received and additional information on hearing procedure is available by writing the EPA address above, ATIN: Ron Wilson, or for review and copying at 345 Courtland Street, 2nd floor, Atlanta, Georgia, between the hours of 8:15 s.m. and 4:30 p.m. , Monday through Friday. A copying machine is provided for public use at a charge of 204 per page.

W e permit will be effective on the date given above provided that no request for an evidentiary hearing is granted by the Agency. If such a request is granted, all contested provisions of the permit will be stayed pending final Agency action. All uncontested provisions of the permit will becane effective on the effective date or the permit.

REQUEST FOR EVIDENTIARY HEARING Any interested person may subnit a request for an evidentiary hearing within thirty (30) days of service of this notice. %e request and two copies thereof must be subnitted to the Regional Hearing Clerk, Environmental Protection Agency, 345 Courtland Street, N.E. , Atlanta, Georgia, 30365.

Subnission of the request will be within the time period if mailed by Certified Mail before the thirtieth day. %e request must contain:

9 (1) the name, mailing address and telephone number of the person making l

such request; (2) A clear and concise factual statement of the nature and scope of the interest of the requester; (3) The names and addresses of all persons whczn the requester represents; and (4) A statement by the requester that, upon motion of any party, or sua ,

sponte by the Presiding Officer and without cost or expense to any other

_ party, the requester shall make available to appear and testify, the following:

(i) 'Ihe requester; (ii) All persons represented by the requester, and (iii) All officers, directors, employees, consultants and agents of the requester.

(5) Specific references to the contested permit terms and conditions, as well as suggested revised or alternative permit terms and conditions (not excluding permit denial) which, in the judgement of the requester, would be required to implement the purposes and policies of the Act.

(6) In the case of challenges to the application of control or treatment technologies identified in the statement of basis or fact sheet, identification of the basis for the objection, and the alternative technologies or ccznbination of technologies which the requester believes are necessary to meet the requirements of the Act.

(7) Specific identification of each of the discharger's obligations which should be stayed if the request is granted. If the request contests more than one punit term or condition then each obligation which is proposed to be stayed must be referenced to the particular contested term warranting the stay.

(8) Each legal or factual question alleged to be at issue and its relevance to the permit decision.

(9) As estimate to the hearing time necessary for adjudication.

(10) Information supporting the request or relied upon which is not already a part of the adninistrative record required by 40 CFR 124.18 (45 Fed.

Reg. 33491, May 19, 1980).

The final Agency decision on the permit provisions contested at an evidentiary hearing will be made in accordance with Title,40, Code of Federal Regulations, Subpart E, found at 45 Federal Re ' ster 334p, g. seg. -
