Dear Mr. Wene:

Your letter of January ll, 1983, relative to Public Notice No. 02TN007 for the referenced plant requested "that continued monitoring and direct notification be included as a requirement in any NPDES permit granted". This request was specifically related to accidental discharges of radioactivity.

You correctly note in your letter that the " discharge of radioactive material is to be controlled by the U. S. Nuclear Regulatory Conmission". Therefore, it is beyond EPA jurisdiction under the Clean Water Act to include the requirements you requested in the NPDES Permit.
