APPLICATION TO AMEND CONSTRUCTION PERMIT Pursuant to 10 C.F.R. SS 50.55(b) and 50.90, Public Service Company of Indiana, Inc. (" PSI"), on behalf of itself and its co-licensee, Wabash Valley Power Association, Inc.,
hereby applies to the Nuclear Regulatory Commission to amend paragraph 3A of Construction Permit No. CPPR-170 issued in this docket on Apr il 4, 1978.
Paragraph 3A of said Construction Permit establishes the earliest date for completion of the facility as January 1, 1982, and the latest date for completion as January 1, 1984.
PSI requests that those dates be amended to read March,1, 1986 and March 1, 1988, respectively.
Following the issuance of the Construction Permit in 1978, construction of Marble Hill Unit 1 was commenced by PSI.
However, on August 7, 1979, PSI voluntarily suspended all safety-related work on the site due to growing concerns about

o the adequacy and effectiveness of its quality assurance program. The cessation of safety-related work was thereaf ter mandated by a confirmatory order issued by the Commission's Director of Inspection and Enforcement on August 15, 1979. On May 15, 1980, the Director issued a further order gradually rescinding the August 1979 stop-work order. The gradual rescission order remained in effect. until February 12, 1982, when it was terminated by a letter from the Director.
Although PSI was able to continue nonsafety-related work during this period, the cessation of safety-related work had an impact on Marble Hill's original ambitious construction schedule. Subsequent design revisions, added work complex it ies , additional scope, increased regulatory requirements and PSI's expanded commitment to quality assurance for the remaining construction activities have further expanded the schedule with a combined effect of extending the projected overall construction period for approximately four years.
PSI believes that the amendment requested in this application involves no significant hazards considerations and no undue risk to the health and safety of the public. PSI therefore requests that the Commission grant this application l
j without prior notice and publication, as permitted by S 189(a) of the Atomic Energy Act of 1954. PSI also submits that the amendment of the Construction Permit requested in this application will involve no significant change in the i
environmental impacts previously considered in the Final Environmental Statement for Marble Hill, NUREG-0097.
Pursuant to 10 C.F.R. SS 50.30(e) and 170.22, PSI has determined that the amendment herein requested is a Class II amendment. Accordingly, a filing fee of $1,200 is being submitted herewith.
WHEREFORE, PSI requests the Commission to amend paragraph 3A of Construction Permit No. CPPR-170 to provide that the earliest date for the completion of the facility is March 1, 1986, and the latest date for completion is March 1, 1988.
