Dear Mr. Matos:

We have reviewed the final revisions to the Georgia Regulations Chapter 391-3-17, received by our office on March 4, 2019. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2012-4, 2013-2, 2015-1, 2015-3, and 2015-5 as identified in the enclosed State Regulation Status (SRS) Data Sheet.

We discussed our review of the regulations with you on March 20, 2019.

As a result of our review, we have five comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Georgia, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Georgia regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. No person may initially transfer or distribute source material to persons generally licensed under subparagraph (b) of this section, or equivalent regulations of an Agreement State or NRC, unless authorized by a specific license issued in accordance with 391-3 .02(5)(h), 10 CFR 40.54, or equivalent provisions of an Agreement State.

GA needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 40.22(e).

1) In subparagraph k.1(ii), GA needs to add 10 CFR 40.22 and equivalent Agreement State regulations, in addition to their regulations;
2) In subparagraphs k.2, k.2(iii),

and k.3, GA needs to add or NRC after Agreement State.

3) In the last sentence of k.3.,

GA needs to add or NRC after Agreement State; and the last words of this sentence should be upon request by the agency or NRC and not the Department.

GA needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 40.55(d).
