Environmental Review - Permitting and Land Transactions Subject Number: LM-300 Subject Topic: Revision Summary Issue Date: 01/20/2006 Location(s): Palisades ISSUE DATE EFFECTIVE REVISION DESCRIPTION DATE 01/20/2006 01/20/2006 Added LM-330, Archeological/Cultural/Historic Resources, to interface with Nuclear Management Company's Archeological, Cultural, and Historic Resources Procedure, FP-RP-ENV-01. These procedures provide direction for the implementation of activities consistent with The National Historic Preservation Act of 1966 (NHPA), As Amended.

They specifically provide for archeological, cultural, and historic resource surveys where construction, major modifications, or land use change have the potential to impact known or unknown archeological, cultural, or historic resources or when such resources are discovered on the Palisades site. Where archeological, cultural, or historic resources are discovered these procedures further provide for contact and consultation with the State Historic Preservation Officer (SHPO) to review reconnaissance level results, direct additional surveys, and facilitate the protection, avoidance, or mitigation of a site in conformance with the NHPA.

Title:

Environmental Review - Permitting and Land Transactions Subject Number: LM-330 Subject Topic: Palisades Cultural Resources Issue Date: 01/20/2006 Location(s): Palisades Summary This procedure provides for the interface between Consumers Energy Company and the Nuclear Management Company, LLC in addressing the potential impact of onsite land use, construction, or operational modifications on Palisades Nuclear Plant archeological, cultural, or historic resources. When the NMC Environmental Coordinator (EC) notifies Consumers Energy Company's Environmental and Laboratory Services Department-Land and Water Management Section (E&LS-L&WM) that an archeological, cultural, or historic resource may be present on the Palisades Nuclear Plant property, E&LS-L&WM will contract with a qualified archeologist/cultural/historic resource specialist to perform a reconnaissance survey of the area where the resource is located and document the survey and its results. If the presence of the archeological, cultural, or historic resource is confirmed by the survey, E&LS-L&WM will confer with the State Historic Preservation Officer (SHPO) with regard to the necessity for additional investigations to further define the resource. If a resource of significance to the SHPO is confirmed and defined, E&LS-L&WM will coordinate with the EC, NMC's contractors, and the SHPO to avoid, mitigate, or otherwise protect the resource.

E&LS-L&WM will provide the EC with a copy of all correspondence with the SHPO and maintain a copy of this correspondence for the duration of facility ownership.

E&LS--L&WM Responsibilities:

1. Initiation of reconnaissance survey--When the EC contacts E&LS-LWM under item 16 of the LM-351 checklist to indicate that a project will be performed in or near an area known to contain an archeological, cultural, or historic resource, E&LS-L&WM shall contract for or otherwise provide the services of a qualified archeologist/cultural/historic resource specialist to undertake a reconnaissance survey of the affected area to determine if archeological/cultural/historic resources are present. Documentation of the reconnaissance survey will be provided to the EC for NMC files and a separate file will be maintained by E&LS-L&WM for the duration of Plant ownership.
2. Initiation of reconnaissance survey--When the EC contacts E&LS-L&WM under NMC procedure FP-RP-ENV-01 that a potential archeological/cultural/historic resource has been located, either independent of a project or in the area of a proposed construction or modification project, E&LS-L&WM will contract for or otherwise provide the services of a qualified archeologist/cultural/historic resource specialist to undertake a reconnaissance survey of the affected area to determine if archeological/cultural/historic resources are present. Documentation of the reconnaissance survey will be provided to the EC for NMC files and a separate file will be maintained by E&LS-L&WM for the duration of Plant ownership.
3. Phase I, Phase II Surveys, other information gathering--If the reconnaissance survey confirms the presence of an archeological/cultural/historic resource on the Palisades property, E&LS-LWM will provide a copy of the reconnaissance report to the SHPO and confer with the SHPO to determine if additional studies are required to adequately define the resource. E&LS-L&WM will confer with the EC and the SHPO over the course of such surveys and provide them with the survey results.
4. Resource avoidance, protection, mitigation--If the SHPO determines that the resource is significant, E&LS-L&WM will coordinate with the SHPO, the EC, and NMC's contractors to assure that the resource is avoided, mitigated, or otherwise protected.
5. A copy of all E&LS-L&WM correspondence with the SHPO will be provided to the EC for NMC's files. E&LS-L&WM will maintain a copy of this correspondence in its files for the duration of Plant ownership.
