OF THE JUNE 17, 2019, PUBLIC MEETING WITH NUSCALE POWER, LLC, TO DISCUSS NUSCALES REVISED DESIGN CERTIFICATION APPLICATION, TIER 2, CHAPTER 20, MITIGATION OF BEYOND-DESIGN-BASIS EVENTS On June 17, 2019, representatives of the U.S. Nuclear Regulatory Commission and NuScale Power, LLC (NuScale), held a public meeting to discuss NuScales revised information regarding its mitigation of beyond-design-basis events strategy in the Design Certification Application, Tier 2, Chapter 20, Mitigation of Beyond-Design-Basis Events. captures the summary of the topics discussed during the meeting. The agenda and list of meeting attendees are included in Enclosures 2 and 3, respectively. OF THE JUNE 17, 2019, PUBLIC MEETING WITH NUSCALE POWER, LLC, TO DISCUSS NUSCALES REVISED DESIGN CERTIFICATION APPLICATION, TIER 2, CHAPTER 20, MITIGATION OF BEYOND-DESIGN-BASIS EVENTS On March 28, 2019, NuScale Power, LLC (NuScale), submitted a letter to the U.S. Nuclear Regulatory Commission (NRC), entitled, Review of NuScales Design Certification Application with Respect to Mitigation of Beyond-Design-Basis Events Final Rule, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19088A210), and informed the staff that it was revising its design certification application (DCA), Chapter 20, Mitigation of Beyond-Design-Basis Events,as well as technical report, TR-0816-50797, "Mitigation Strategies for Extended Loss of AC Power Event, to make conforming changes based on the Commissions January 24, 2019 staff requirement memorandum on mitigation of beyond-design-basis events (MBDBE) final rule (ML19023A038). The MBDBE final Rule is scheduled to be codified as 10 CFR 50.155, and available to public, in September 2019.

NuScale submitted an advance copy of the revised DCA Chapter 20, to be incorporated in Revision 3 of the DCA, in a letter dated, June 7, 2019, (ML19158A456), and also submitted Revision 1 to TR-0816-50797 on May 31, 2019, (ML19151A853). The purpose of this public meeting was for NuScale to discuss the updated information and revised approach to addressing the requirements of 10 CFR 50.155, Mitigiation of Beyond Design Basis Events..

During the meeting NuScale described their approach to MBDBE and changes to TR-0816-50797 and Chapter 20. The staff pointed out to NuScale that 10 CFR 50.155(e) requires a licensee to monitor the spent fuel pool level during a beyond-design-basis event to allow operators take appropriate actions when the water level reduces to below the technical specification limit. The staff further stated that NuScales revised information indicate that the installed spent fuel pool level instrumentation (SFPLI) can monitor the pool level for 14 days without any operator actions, however, the power source (batteries) for the SFPLI only lasts for six days. NuScale explained that the batteries can be replaced with commercially available batteries when they run out. The staff requested NuScale to update the FSAR to indicate that the operator action is required to replace the batteries. NuScale agreed to discuss this issue internally and inform the staff in a follow-up public meeting.
