Theproprietary materialforwhichwithholding isbeingrequested byIndiana&MichiganElectricCompanyisofthesametechnical typeasthatproprietary materialsubmitted byWestinghouse previously inapplication forwithholding AW-80-32, andwasaccompanied byanaffidavit signedbytheownerofthepro-prietaryinformation, Westinghouse ElectricCorporation.

Further,theaffidavit AW-80-32submitted tojustifythepreviousmaterialonJune13,1980isequallyapplicable tothismaterial.

Accordingly, thisletterauthorizes theutilization ofthepreviously furnished affidavit insupportoftheIndiana8MichiganElectricCompanyDonaldC.CookNuclearPlants1and2.Acopyoftheaffidavit isattached.

Inaddition, itisnotedthatthesameproprietary reportwassubmitted June19,1981,AEP:NRC:0531A, HuntertoDenton.However,duetoamisunderstanding, thewrong(CAW-80-75) application forwithholding wasreferenced inthatsubmittal.

Pleaseacceptthisapplication forwithholding asaclarification supplement totheapplication forwithholding andaffidavit.

Technical contentofthepro-prietaryreportdoesnotchangewiththissubmittal.

Underthatsystem,information isheldinconfidence ifitfaIlsinoneormoreofseveraltypes,thereleaseofwhichmightresultinthelossofanexistingorpotential com-petitiveadvantage, asfAlaws:(a)Theinformation revealsthedistinguishing aspectsofaprocess(orcomponent, structure, tool,method,etc.)whereprevention ofitsusebyanyofWestinghouse's competitors withoutlicensefromWestinghouse consti-tutesacompetitiveeconomicadvantage overothercompanies.

(b)Itconsistsofsupporting data,including testdata,relativetoaprocess(orcomponent, structure, tool,method,etc.),theapplication ofwhichdatasecuresacompetitive economicadvantage, e.g.,byoptimization orimprovedmarketability.

(e)Itrevealsaspectsofpast,present,orfutureMest-inghouseorcustomerfundeddevelopment plansandpro-gramsofpotential commercial valuetoMesiinghouse.

(f)Itcontainspatentable ideas,forwhichpatentpro-tectionmaybedesirable.

(g)ItisnotthepropertyofMestinghouse, butmustbetreatedasproprietary byMestinghouse according toagreements withtheowner.TherearesoundpolicyreasonsbehindtheMesiinghouse systemwhichincludethefollowing:

(a)Theuseofsuchinformation byMestinghouse givesMesiinghouse acompetitive advantage overiiscom-petitors.

Itis,therefore, withheldfromdisclosure toprotecttheMestinghouse competitive position.

~V~~~VCAM-80-32(b)Itisinformation whichismarketable inmanyways.Theextenttowhichsuchinformation isavailable tocomoetitors diminishes theWestinghouse abilitytosellproductsandservicesinvolving theuseoftheinformation.(c)Usebyourcompetitor uouIdputWestinghouse atacompetitivedisadvantage byreducinghisexpenditureofresources atourexpense.(d)Eachcomponent ofproprietary information pertinent toaparticular competitiveadvantage ispotentially asvaluableasthetotalcompetitive advantage.

I,competitors acquirecomponents ofproprietary infor-mation,anyonecomponent maybethekeytotheentirepuzzle,therebydepriving Westinghouse ofacompetitive advantage.

(e)Unrestricted disclosure wouldjeopardize thepositionofprominence ofWestinghouse intheworldmarket,andtherebygiveamarketadvantage tothecompetition inthosecountries.

(f)TheWestinghouse capacitytoinvestcorporate assetsin,researchanddevelopment dependsuponthesuccess'nobtaining andmaintaining acompeti,tive advantage.

AW-80-32(iii)Theinformation isbeingtransmitted totheCommission inconfidence and,undertheprovisions of10CFRSection2.790,itistobe'eceived inconfidence bytheCommission.

(iv)Theinformation soughttobeprotected isnotavailable inpublicsourcestothebestofourknowledge andbelief.(v)Theproprietary information soughttobewithheldinthissub-mittalisthatwhichisappropriately markedinWCAP-9725, "Westinghouse Technical SupportComplex,"

(Proprietary),

beingtransmitted byWestinghouse letterNo.NS-TMA-2261, AndersontoMiller,datedJune13,1980.Thisreportisbeingsubmitted pursuanttotheNRC'sTopicalReportProgramforgenericreviewbytheRegulatory Staffandisexpectedtobereferenced inseverallicenseeandapplicant submittals inresponsetocertainNRCrequirements resulting fromtheTMI-2event.Thisinformation ispartofthatwhichwillenableWesting-houseto:(a)Applyforpatentprotection.

(b)Optimizecontrolroomoperatorandtechnical supportpersonnel man-machine interface designsandcriteria'c)

Assistitscustomers toobtainNRCapproval.

(d)JustifythedesignbasisfortheTechnical SupportComplexfunctions andinputs. AW-80-32Furtherthisinformation hassubstantial commercial valueasfollows:(a)Westinghouse planstosellthesystemdesignandequip-mentdescribed inpartbytheinformation.

(b)Westinghouse planstoselltheuseoftheinformation toitscustomers forpurposesofmeetingNRCrequirements forlicensing documentation.

(c)Westinghouse canselltestingservicesbasedupontheexperience gainedandthetestequipment andmethodsdeveloped.

APublicdisclosure ofthisinformation islikelytocausesubstantial harmtothecompetitive positionofWestinghouse because(1)itwouldresultinthelossofvaluablepatentrights;and(2)it'ouldenhan'cetheabilityofcompetitors todesign,manufacture, verify,andsellelectrical equipment forcommercial powerreactorswithoutcommensurate expenses.

Also,publicdisclosure oftheinformation wouldenableothershavingthesameorsimilarequipment tousetheinformation tomeetNRCrequirements forlicensing documentation withoutpurchasing therighttousetheinformation.

Thedevelopment oftheequipment described inpartbytheinformation istheresultofapplyingtheresultsofmanyyearsofexperience inanintensive Westinghouse effortandtheexpenditure ofaconsiderable sumofmoney. AW-80-32Inorderforcompetitors ofWestinghouse toduplicate thisinformation, similarengineering programswouldhavetobeperformed andasignificant manpowereffort,havingtherequisite talentandexperience, wouldhavetobeexpendedforsystemdesignsoftwaredevelopment.
