On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your March 30, 2017, letter requesting a fee waiver for activities performed for NRC's review of Technical Specifications Task Force (TSTF)-567 be granted a fee waiver pursuant to the provisions under Title 10 of the Code of Federal Regulations (10 CFR) 170.11(a)(1)(iii).
Initially, I note that the exemption provisions under 10 CFR 170.11 were revised by the fiscal year 2016 fee rulemaking. The NRC amended the language under 10 CFR 170.11(a)(1) to clarify when stakeholders can receive a fee exemption after submitting a report to the NRC for review. Specifically, the NRC removed paragraph (a)(1)(iii). This change was effective August 23, 2016. Therefore, the NRC staff has reviewed your request based on the following regulations10 CFR 170.11(a)(1)(i) and 10 CFR 170.11(a)(13):
10 CFR 170.11(a) No application fees, license fees, renewal fees, inspection fees, or special project fees shall be required for: (1) A special project that is a request/report submitted to the NRC . . . (i) In response to a Generic Letter or NRC Bulletin that does not result in an amendment to the license, does not result in the review of an alternate method or reanalysis to meet the requirements of the Generic Letter, or does not involve an unreviewed safety issue.
10 CFR 170.11(a)(13) All fee exemption requests must be submitted in writing to the Chief Financial Officer in accordance with § 170.5,1 and the Chief Financial Officer will grant or deny such requests in writing.
The traveler, a document submitted by the TSTF that proposes changes to the standard technical specifications, is related to Generic Letter (GL) 2004-02, Potential Impact of Debris Blockage on Emergency Recirculation during Design Basis Accidents at Pressurized-Water Reactors, September 13, 2004 (ADAMS Accession No. ML042360586) and NRC Bulletin 2003-01, Potential Impact of Debris Blockage on Emergency Recirculation during Design-Basis Accidents at Pressurized-Water Reactors, June 9, 2003 (ADAMS Accession No. ML031600259). 10 CFR 170.5 provides that All communications concerning the regulations in this part should be addressed to the NRC's Chief Financial Officer, either by mail to the U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001; by hand delivery to the NRC's offices at 11555 Rockville Pike, Rockville, Maryland; or, where practicable, by electronic submission, for example, via Electronic Information Exchange, or CD-ROM.

Additionally, approval of the traveler would provide a means for licensees to revise their plant-specific technical specifications to avoid unnecessary shutdowns and emergency amendments; thereby increasing safety and decreasing the Office of Nuclear Reactor Regulation staff workload. The traveler would lead to improved safety and more efficient use of NRC staff resources.
The NRC staff concludes that the activities in the letter requesting a fee waiver for NRC's review of TSTF-567, dated March 30, 2017, fulfills the criteria required by 10 CFR 170.11(a)(1)(i) and 10 CFR 170.11(a)(13); and consequently, the fee waiver request is approved. Future revisions to TSTF-567 will require you to submit a new fee waiver request for NRC consideration, pursuant to the new fee-exemption provisions under 10 CFR 170.11(a)(1)(i) and 10 CFR 170.11(a)(13).
