MENT LETTERS It nas cc e to my attention that there may not be any regulation, code or st3r.dard recuiring vendors of ccm ercial-grade items to notify higner tier purchasers of any deviation from the purchase specification discovered :ubsecuent to delivery of the item. Since this infornation may be critical to ensuring the safety of cperating reactors, please ansv.er the follov:ing cuestions:
- 1) Are vendors of commercial-grade items (as defined in 10 CFR Part 21) obligated to notify their purchaser of any deviations from the purchase specification v;hich are dis-covered by the vendor subsequent to delivery of the item?
- 2) If so, pursuant to what regulation, code, standard or legal theory does such an obligation arise?
- 3) What is the current industry practice in this regard?
- 4) What changes in NRC's regulations viould be necessary to ensure that all such information is passed on to a Part 21 vendor throughout the anticipated service life of the item so that the safety significance can be properly assessed?
- 5) Are these changes necessary?
