MENT LETTERS It nas cc e to my attention that there may not be any regulation, code or st3r.dard recuiring vendors of ccm ercial-grade items to notify higner tier purchasers of any deviation from the purchase specification discovered :ubsecuent to delivery of the item.
Since this infornation may be critical to ensuring the safety of cperating reactors, please ansv.er the follov:ing cuestions:
1)
Are vendors of commercial-grade items (as defined in 10 CFR Part 21) obligated to notify their purchaser of any deviations from the purchase specification v;hich are dis-covered by the vendor subsequent to delivery of the item?
2)
If so, pursuant to what regulation, code, standard or legal theory does such an obligation arise?
3)
What is the current industry practice in this regard?
4)
What changes in NRC's regulations viould be necessary to ensure that all such information is passed on to a Part 21 vendor throughout the anticipated service life of the item so that the safety significance can be properly assessed?
5)
Are these changes necessary?
