JOINT MOTION TO HOLD DISCLOSURES IN ABEYANCE PENDING SETTLEMENT DISCUSSIONS Northern States Power Company, a Minnesota corporation (NSPM), and the Prairie Island Indian Community (PIIC) hereby jointly move the Atomic Safety and Licensing Board (Board) to hold document disclosure on the recently admitted PIIC safety culture contention1 in abeyance until further notice, while NSPM and the PIIC discuss possible settlement of the PIICs concerns. Counsel for NSPM and counsel for the PIIC have held preliminary discussions and both believe that further dialogue could be constructive.

If this motion is granted, NSPM and the PIIC would submit a progress report to the Board in one month. In the event that NSPM and the PIIC are unable to reach an agreement, a subsequent conference with all parties and the Board would be helpful to establish the schedule and procedure for the remainder of the proceeding, including the scope and schedule for completion of disclosures.

Counsel for the PIIC has authorized NSPM to file this motion on the PIICs behalf.

Counsel for NSPM has consulted with the counsel for NRC Staff, who has indicated that the Staff supports this motion.
