October 28, 2004Mr. Anthony PietrangeloRisk and Performance Based Regulation Nuclear Energy Institute 1776 I Street, NW Washington, DC 20006-3708
Dear Mr. Pietrangelo:
I am responding to your August 30, 2004, letter requesting a fee waiver under 10 CFR 170.11for Technical Specifications Task Force (TSTF) - 426, Revision 0, "Revise or Add Actions to Preclude Entry into [limiting condition of operation] LCO 3.0.3." For the reasons below, I amgranting a fee waiver for the technical staff's review of TSTF-426 in accordance with the applicable provisions of 10 CFR 170.11. During its acceptance review, the staff has determined that TSTF-426 supports NRC's genericregulatory improvement program (i.e., risk informing certain portions of Technical Specifications) in accordance with 10 CFR 170.11(a)(1)(iii). Specifically, these submittals willassist in the development of guidance for NRC's Initiative 6b (Provide Conditions in the LCOsfor those Levels of Degradation where No Condition Currently Exists to Preclude Entry into LCO 3.0.3) and Initiative 6c (Provide Specific Times in the LCO for those Conditions that Require Entry into LCO 3.0.3 Immediately) for Combustion Engineering Plants. If you have any fee-related questions, please contact Ms. Renu Suri of my staff at 301-415-0161.Sincerely,/RA/Jesse L.
