These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2011-1, as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on October 22, 2019.

Dear Mr. Carpenter:

We have reviewed the final revisions to the Oregon regulations Sections 333-102-0310, 333-102-0200, 333-102-0305, and 333-102-0320, received by our office on October 11, 2019.

These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2011-1, as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on October 22, 2019.

As a result of our review, we have one comment that has been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comment and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS)

Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comment, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Oregon, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Oregon regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Minimization of contamination ORs equivalent regulations to 10 CFR 20.1406(c) state, a description to the extent practical, how operations will be conducted to minimize the introduction of residual radioactivity into the site including the subsurface.

As written, ORs regulations are less restrictive than 10 CFR 20.1406(c) in that they do not require licensees to conduct operations to the extent practical, to minimize the introduction of residual radioactivity into the site, including the subsurface, in accordance with the existing radiation protection requirements.

OR needs to revise their regulations as indicated above to meet the Compatibility Category C designation assigned to 10 CFR 20.1406(c).
