ts 1 and 2 AEC Docket Nos, 0-269, 50-270A, 50-287A, 50-36 and 50-370A

Dear Judge Bennett:

This is to advise you that the Virginia Electric and Power Ccmpany has acw for the first time been served uith the orders of January 24, 1973, granting the Department of Justice's motion to reconsider an earlier Board order, and pre-hearing order no. 6, dated March 22, 1973.

Because of the misunderstandings engendered by the Board's decision not to communicate with Virginia Electric and Power Company (Vepco) directly., may I suggest in the interests of efficiency and fairness that orders and other documents affecting Vepco be sent to us at the following address:

Virginia Electric and Power Company c/o John H. Shenefield Hunton, Williams, Gay & Gibson P. O. Box 1535 Richmond, Virginia 23212 79121809d 4

HUNTON,WILLLuts, GAY & GInsoN

. Reliance upon parties to the proceeding to communicate with non-parties is, on the basis of experience in this proceeding, simply too chancy.

In that connection, I would like to take this opportunity to correct the misimpressions the Board may have as the result of certain exchanges at the pre-hearing held on March 7, 1973.

First, the representative of the Department of Justice, Mr.

Brand, misinformed the Board when he stated that all subpoenaed parties had " objected."

Vepco had submitted a motion merely requesting adequate time within which to determine the nature of its response, and we understood thereafter that the motion had been granted by the Board, subject to certain conditions, in the order of January 8, 1973, paragraph 2.

Second, th:. Brand stated to the Board that his affidavit of February 8, 1973, referred to an order directing Vepco to reply by affidavit.

Of course, his affidavit actually referred only to the entirely different order of January 8, 1973, but made no reference to the crucial order of January 24, 1973, which we had not seen until quite recently.

Accordingly, pursuant to the Board's order of January 24, 4

1973, en behalf of Vapco I enclose an affidavit of an officer of Vepco responding to the speculations of the Department of Justice in its affidavit of February 8,1973, and supporting the enclosed motion to quash or to limit the subpoena on grounds of unnecessariness, burdensomeness, and irrelevance.

Very truly yours,
