REQUEST FOR ENFORCEMENT DISCRETION AT PEACH BOTTOM UNITS 2&3 Dear Mr. Edwards This letter acknowledges receipt of your March 26,- 1999 Notice of Enforcement Discretion Request (Enclosure 1) and documents its resolution.' You requested that the NRC exercise discretion by not enforcing compliance with the actions required in Peach Bottom Atomic Power Station, Units 2 and 3 Technical Specification 3.8.1.b concerning an inoperable diesel generator.

The contents of that letter were discussed with the NRC in a telephone conversation on March 26,1999.

We did not to grant enforcement discretion at that time but decided to reconsider discretion prior to the expiration of the Limiting Condition of Operation based on work progress on the E3 Emergency Diesel Generator (EDG). We note that the E3 EDG'was returned to an operable j

status on March 27,1999, within the 14 day completion time required by Technical Specifications, so no enforcement discretion was necessary.
